have some concerns about the k1 visa

First i want to start of by saying thanks to everyone for helping me with all my questions. everyone is great and this is an awesome site.

i filed for the k1 visa on sept 25th. my fiancee is from colombia and she was talking to a friend of hers that received her k1 visa. she was asking all kinds of questions and the women told my fiancee that we might get denied because of 2 reason. one not knowing for very long and the other is meeting on the internet. we met online in april and i went and visited her in sept. my question is do you think they will deny this because of these 2 reasons and if they do what other options do i have. maybe get married in her country and file for a different visa? thanks in advance for all your help

Meeting on the internet is normal these days, many VJ couples met that way, including us. As long as you have plenty of evidence of a genuine relationship (emails, phone bills, letters, as well as meeting in person) the internet thing and knowing eachother for 7 months before filing is not an issue. While only one meeting is required, it can raise a red flag; if you can, a second visit would be a good idea, before the interview- take lots f photos and, ideally be there for the interview too.

If you get denied, you can appeal or marry and apply for a spousal visa, but no point in applying for another visa unless you have overcome the reason for denial.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Isn't it funny, Once someone recieves a K1 Visa, they all of a sudden become the"Know It All" about Visas, and start giving out opinions like they are fact.

As far your concerns, I wouldn't loose a moment of sleep.

Neither is a concern for the petition, not at all. As for the consulate that is a matter best answered in the regional sub forum. I highly doubt either would be a problem. Just document your realtionship well.

Nobody can say that you must know someone a certain amount of time or you don't really love them or it's not a real relationship. Online is where you meet now, how else will you meet and how else will you meet someone from another country, I think it's weird if you don't meet someone online and you don't marry someone from another country. We are the superior ones, the ones who love and marry foreigners over the internet. Long live interracial marriage ! :thumbs:

Isn't it funny, Once someone recieves a K1 Visa, they all of a sudden become the"Know It All" about Visas, and start giving out opinions like they are fact.
The fiancee should lend a lot more credence to the firsthand knowledge of a fellow Colombiana than to a dismissive opinion from someone who applied at an embassy nowhere near that part of the world.
As far your concerns, I wouldn't loose a moment of sleep.
The OP is obviously alluding not to the USCIS petition process, but to the consular process later, of which the Colombiana friend has firsthand knowledge. At that stage, one can end up losing a LOT of sleep because of these exact concerns and the nasty 221(g) or outright refusal that can result from them. Penguin_ie's advice above is completely accurate and should be followed. And yet again here on VJ, I'm amazed and appalled that any respondents can flatly claim "no problem!" when no one can read the mind or mood of the interviewing Consular Officer or foresee the prevailing policies of any embassy's Immigrant Visa Unit at the time of interview.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

:rofl: Meeting online is not a problem in the slightest. Probably more than half the people on here met online. As for not knowing each other for long time, that might cause a few extra questions at the interview, but providing you have plenty of evidence, and can prove everything you tell them you should be fine. just think evidence, evidence, evidence!!! Wherever you go, whatever you do with each other.... EVIDENCE!!!!
