Hi Leader,

Since the there is no additional fee for filing the I-131 when you file for the AOS (green card) why not file for it at the same time? That way if you need to travel you don't have to submit the application later and wait. The AP takes about 90 days to process whether you file for it with the AOS application or after the AOS application. The green card generally takes longer than that - sometimes significantly longer.

You can't leave the US and return until after you have received either the I-131 or your green card. You use the I-131 to travel before you get your green card but after you have filed for it. You don't need the I-131 once you have your green card as that is sufficient to allow you to re-enter the US.

If your I-94 from your K-1 has expired you are currently out of status until you do file for the AOS. Your legal status in the US expires on the same date as the I-94. You should apply for the AOS before the I-94 expires. The I-131 is useless to you if your I-94 is expired by more than 180 days. They will still give it to you, but if you use it, they won't let you back into the US and you will incur at least a 3 year ban on returning. You will probably also be hassled if you have less than 180 days out of status and use the I-131 but you should still be allowed back in.

Since there is no additional fee to file the I-131 you really should file for it at the same time you file for the I-485.

hey thanks for the reply... i know the details but i have a few questions:

1. If i apply for my aos in one state and then shift to another state to live in the US... will that have any impact on my application.

2. Does USCIS need only the court marriage document or do i have to provide the religious islamic document too.. am a muslim

3. Regarding the affidavit of support.. I need it since my US citizen fiancee doesnt do a job and depends on benefits from the govt and stuff. A relative of mine is a rich man but he is not working these days. Will it be ok if he signs the document?

4. In my case it took 2 years to obtain my k1 visa, normally it takes months... Will this delay be compensated in my green card process?

5. Do i have to take a medical exam when i took one before coming to US... it was in july, 2009.

Kindly please answer these questions of mine.... I will be thankful...
