VERY CONFUSED ABOUT LETTER FROM NVC

Hi,

I'm a Canadian with a 10 yr green card. I came on a K-1 Visa. At the time, my then 9 yr old daughter didn't move with me.

She is now 13 and able to move here.

My husband applied as her step-father. We received a letter asking him to go online pay $70.00 for AOS fee. print out a letter with a bar code. It says we must return this cover sheet with the petitioner's completed forms and supporting documents.

It says to complete the choice of agent & address form.

I thought he was the petitioner and my daughter is the beneficiary?

It states to appoint someone as the agent to recieve documents.

Does my daughter do this.

Can my husband be the "Agent" can we have the documents sent to use as my daughter is only 13 yrs old and I'm afraid they will get lost.

Also who is to sign this paper? My daughter is a minor. Does my husband sign this?

We don't have a lawyer. We did the K-1 for me by ourselves and figured we would do my daughter's visa by ourselves too. No lawyer involved.

Please help ASAP as this is holding up my daughter's visa and I've already missed 4 years of her life!

Dec. 08th/05 Recieved Snail mail letter for AOS Interview Feb 15th 7:40 AM.

Feb. 15th. /06 AOS Interview SUCCESS !!!! no more to deal with for another 2 yrs!

Feb. 27th./06 Recieved Greencard in the mail

August 4th/06 Our First Wedding Anniversary !!

Feb. 8th 08 Sent in Packet to remove conditions

Feb 23rd 08 Recieve NOA letter stating they are extending my Greencard for another year.

March 11th 08 biometrics appt.

May 29th 08 recieved email stating Card production ordered

June 7th 2008 10 yr card recieved.

since your husband is the petitioner, he can be appointed the choice of agent. as for your daughter signing the papers, does she have a legal guardian? i'm not sure i understood your situation. you live in the US with your husband and your 13 year old daughter is in canada?

Timeline:

Sent in I-130 form: 01/29/09

Interview Date: 11/08/09 (APPROVED!)

Visa in Hand: 11/12/09

POE: 01/30/10 (!!!!) at JFK Airport in NYC... can't wait!

Got the green card maybe 8 weeks after 01/30/10...

TBC....

Best thing to do is call NVC explain to them the situation, they will tell you who can sign for her, most likely her guardian, the one who has legal rights over her while she is living apart from you. Once you ge this settled, you will go quickly thru NVC.

I believe your husband is able to sign for her, as long as he adopted her. Best wishes.

I believe my situation is very similiar to yours. My husband is a G.C. 10 year holder, who came here on a K3 visa. His 3 daughters did not come with him right away either. Now, 5 years later we are petitioning them to come. One of the girls petition just got approved through NVC, and the other 2 should be finished in the next working day or two.

I also received very good guidance through this website as well as some very nice folks at NVC. Anyway...

We filled out all of the forms for the girls, since they are also minors (10, 13, and 15). My husband (their father who has joint custody) signed the papers for the girls, and put the girls name, his name and then father (example Susan Smith John Smith-Susan's father).

I appointed myself (the petitioner) as the agent of choice. Everything came to us. That way since my husband could sign for the papers anyway it didn't have to be mailed to/from overseas.

One thing you will need (and hadn't seen it on anything, but was told by fellow VJers) is a letter from the other parent giving permission for the child to immigrate to the U.S. We had it notarized as well. I sent this in with the IV application.

Please, if I can help you in any way, let me know. Since mine petition literally just got approved for the girls, hopefully I can help you out, as others so kindly helped me.
