I Applied for MedQuest,Free Lunch,WIC for my KIDs

Hi,

I am currently adjusting my status together with my derivative daughter (K2). I was wondering if me applying for MedQuest Insurance ( free insurance from the state ) for my US citizen kid (I have 2 kids, 1 is a US citizen and the other one is K2 who is not qualified for the MedQuest Insurance yet), I also applied for free lunch at school for my K2 daughter with free status for her A+ (after school program) and WIC checks for my US Citizen kid. Will those affect our AOS application? Please let me know.

I doubt that you applied for these benefits for your USC child. Your USC spouse probably did.

At any rate, USC's (your child) can receive benefits.

The 'hot lunch' program is not considered a means tested benefit. Neither is WIC.

yes you are right, its my USC husband who applied for our USC child. When my K2 daughter gets her green card, does that mean I cant apply for her MEdicaid?

She probably won't be eligible for it. Depends on the requirements in your state of residence. In my state, you must be a US citizen to qualify for Medicaid.

here in Hawaii, for adults, you must be a US citizen or have stayed for at least 5 yrs. but for the keiki or for kids, for as long as they are legal perminent resident / valid green card, you can apply for medicaid. However, once she gets her greencard, according to the affidavit of support instructions, whoever filed for it would have to pay the government/state for receiving such benefit, is that right?

Depends on whether or not Hawaii considers it a means-tested benefit and whether or not they would go after you for repayment. If they are permitting LPR's to receive the benefit then it's doubtful they would go after compensation.

The only way to be sure is to ask your social worker if the benefit is considered means tested by the State of Hawaii, and if there is any possibility of them demanding repayment from an alien's financial sponsor.

Point of clarification - Keiki is probably not "Medicaid". It more likely falls under CHIP programs.
