Hello.

I entered the US as K-1 and got married. I filed AOS 2 weeks ago and have not heard from USCIS yet.

To get a driver's license or photo ID, I went to DMV. On their website, they listed what I needed as a K-1 visa holder so

I brought everything they requested.

They were inexperienced with my situation and they looked up INS website to check my immigration status. They told me

it showed that ' further verification needed' so, practically I did not have any legal status.

For me I have followed every step legally, and now am married to a US citizen. I was very upset that they treated me like illegal.

A lot of people on this website have obtained their driver's license when they were K-1 or waiting for AOS.

They were not sure about my situation and told me they will have their headquater decide if they would give me ID or not.

Do I have to wait to receive EAD to get a state ID or driver's license?

If you have dealt with DMV before you received your EAD, please let me hear your story.

Depends on the state. In Vermont we needed only the I-797c receipt for reciving the AOS filing, but it sounds like you do not have that.

Wait until you get your receipt and go back. Study the state manual and be clear what is requireed and then demand they follow through with their rules. Ask for a supervisor. Untrained clerks tend to invent new law when presented with a situation they do not understand, do not fall for it.

We had this problem with our son (K-2) when they demanded he have a social security number to get a drivers permit. No such requirement. "Oh yes, it is in the manual" Please show me. She could not, she got the supervisor. Supervisor says no SSN is needed just enter 999-99-9999 in the SSN place. OK, fine, then the brilliant bimbo asks for his marriage certificate. WHAT!!?? He is a K-2, NOT a K-1 and specifically is NOT married. Called the supervisor back, OK, next? Finally she gives him his permit. While we are waiting for his photo to be taken a young woman from Columbia comes in, recent K-1, married but has no SSN yet. The SAME clerk tells this woman she needs an SSN!!!!!!!!! I stopped the woman on her way out and told her to get the supervisor. AGAIN the same supervisor tells the SAME clerk how to do it without an SSN! They walk among us...be aware!

I was wondering if you guys could just go to any dmv and get it? When we tried they told us to go a specific dmv office that serves aliens for this county in Fl. We had some trouble there but their boss explained everything to them so it wasn't too bad. Only needed the noa of aos and of course all of the normal stuff. But even at that office most of the people there were students or on work visas. So I think K1 and K3 are pretty rare for the dmv workers even at offices like that.

Well, I received a letter from DMV Harrisburg about decision whether of not I can get a driver's license.

the letter says that I am not eligible to apply for a PA driver's license or photo ID because

they obtained a report from USCIS that I will not be lawfully present in the US at least for a year.

What is wrong with them??? I submitted passport with K-1, marriage license, my husband's US birth certificate,

797Cs (AOS receipt, EAD receipt, and appointment letter), and social security card, previous driver's license.

How could they possibly get e report saying I will not be lawfully present in the US at least a year?????

I am so mad. :wacko:

our experience was also that green card was required.

hopefully you will get transferred to CSC and approved soon. as i stated in an earlier thread, we had researched this issue early in the process and arranged for a chinese driving liscense and an international translation card. that combo was good for a year.

We just moved here in new mexico and i tried to get an id,i was told that they dont accept any papers from the immigration,but as long as your name is in the lease/rental agreement and utilities like phone,cable,internet,you'll be fine :blink: .me and my husband had a hard time looking for the DMV office,it turned out that it's called MVD :D

Do you have a Japanese license with the Translation?

Yes I do, I also have international driver's license so I can drive for a year.

but still wants a proper ID from the state I live in you know.
