Hi I have a TN Visa that I renewed back in May. This past August I got married to a US citizen.

We are planning to go to Canada for the Christmas holidays.

My question is should I wait to apply for I-130 and AOS until after the holidays? I hear there may be some problems entering the US back while the application is processing?

PLease advise.

Thanks!

Ethan

I used to be on a TN before so please please and please simply visit Canada on your TN then come back to file and AOS once you know u can devote at least 3 months of your time to being within the United States.. The point is, your TN gives you a valid I-94 but on the other hand, it is at the discretion of the U.S customs/immigration officer to let you back in if they know you have a pending application without an AP.. So why take that chance? I'd advice you file for an AOS upon your return from Canada...

It's not a wise decision to leave the country while married and on a TN - if the border guard realizes you're married, then your TN status is now invalid since you now have permanent intent to immigrate (since you're married to a USC they're not going to believe that you're here temporarily) and they will not let you back in.

The best idea would be to apply for AOS and hope that your Advance Parole will get approved in time....

here's a good post that describes going from TN to GreenCard:
