Hers is a tough question, my husband and I Married on a K-1 in 2005, received permanent residency Oct 2005,

I have been in USA for 465 days to this date when all the days are counted, we travel back and forth from the Philippines, he works in the Philippines, my home country where we met, he was called back for work in Philippin, so I am with him. I was in the Philippines 11 months and returned to USA, no problems, but obviously we want to be together. I don't have enough days to apply for citizenship, what are my options? I don't want to loose residency but we also cant afford two homes and be apart?

thanks!!

Is your husband working for a US company, say as a government contractor or similar? If so, you may be exempt from the US residency requirement.

Since you are no longer residing in the U.S. you should turn in your permanent resident card and apply for IR-1 when you are ready to return to the U.S. to reside.

I had a job once with a US firm that took me all over the place, but was single at the time and no wonder why. Just reading between the lines on the N-400, want permanent residency in the USA, living together, and most important, paying taxes to the US government each and every year. Each case is unique and involved, would contact a competent immigration attorney if you can find one. Or can try to prove this by yourself, does get complicated.

At some point, they will probably take the card from you and deny entry. If you want to visit the U.S., but reside outside, you need a tourist visa. With your USC husband working in the Philippines and your previous permanent residence, you stand a good chance of getting the tourist visa approved.
