Help please.....Petitioning Grandkids

My Mom is already a US Citizen. Will she be able to petition her grandkids ages 7-12 to come to the US? If so, what are the processes that should be done? Please anyone? Help?

Hey Kimmy,

You've already asked this question and it has already been answered. Your mom cannot petition for her grandkids. The law does not allow a grandparent to petition for a grandchild.

I believe she can petition her own child and the grand kids can come along also if under 21 and not married.

True, the grandkids can be derivative beneficiaries if grandma petitions for her child. However, it will take a long time and there are some hurdles to overcome.

The current PD for F1 cases for Filipino beneficiaries, USC petitioning for an unmarried child, is Oct. 8, 1993, and the current PD for F3 cases for Filipino beneficiaries, USC petitioning for a married child, is Oct. 15, 1991.

Visas will not be available for 16-18 years. If either the petitioner or beneficiary dies before a visa becomes available, the petition is automatically revoked and no one can immigrate to the US. If the children are over age 21 in 16-18 years and CSPA gives them relief and they are not married, then they would qualify as derivative beneficiaries. No one can predict CSPA applicability. In all likelihood, the grandkids will age out before visas become available.

You will find that Filipinos are VERY patient. My wifes cousin came here in 1986 on a spouse visa years ago. Got her USC and petitioned her mother and father 5 years after mom arrived and got her USC and she petitioned her married daughter with 3 kids. Daughter and kids came and daughter waited 5 years and petitioned her hubby after getting her USC. Hubby just recently got here.

Only "bad" thing was one of his daughters was knocked up when he got here.

I forgot to mention my wifes cousin [friend of mine] introduced me to my now wife and anak. My wife is getting her USC in a couple of months.

Yeah you got it. As soon as my wife gets her USC the whole thing will start over.
