K1 entrants have been put into deportation hearings on VJ so it can happen. You can technically apply for EAD only but its worthless because it would have only been good when your I 94 was valid. Can you get someone to help you? Your probably going to need a sponsor anyway.

too bad until now we haven't filed for a change of status yet. we just don't have the money for that. we are broke, real broke. it's almost 1 year now. now, my question is, is it possible for me to apply for a temporary work permit only for now so that i could work prior to changing my status from k1 to permanent residence? another option that we are considering is for me to take the NCLEX. What do u guys think? Thanks for all your response and advise.

DO NOT inform USCIS (by asking if you can get a temporary work permit/EAD) that you have not applied for AOS yet because you don't have the money, as of now you are out of status so if they find out, you'll be sent home.

before taking the exam, make sure your immigration status is not going to be asked in any of the forms or you'll just get yourself into trouble.

This is not totally true. Even if she is married to a USC and overstays, she is "out of status". What this means is that, while she's not on any "Wanted" list (I don't think they have those, but what I mean is that she is not actively being looked for :huh: ), she could get deported if she did anything illegal, or if a cop decided to be a #######. For example, I am currently out of status, I have had secretary, doctors and one cop (I wasn't the one in trouble, I was giving a deposition) ask me for my SSN, every time, I explained that I did not have one as I had married by husband, a USC, and we had not filed yet.

11/03/10 ------- AoS (I-130/I-485) Package mailed out (Priority Mail)

11/07/10 ------- AoS Package received and singed for

11/10/10 ------- NOA1 received for I-130, I-485 and I-765 (emails)

11/12/10 ------- NOA1 received for I-130, I-485 and I-765 (hard copies)

11/12/10 ------- Touches on I-130, I-485 and I-765

11/19/10 ------- Biometrics appointment letter received

12/06/10 ------- RFE for I-693 (I think the issue is that it was not signed. Called USCIS and will receive a letter in a few days explaining)

12/13/10 ------- Biometrics done

12/16/10 ------- EAD card in production (email)

12/20/10 ------- Received "Letter of Explanation" for RFE (Service Request to expedite my case. Called USCIS and was told to ignore that and just send in response to RFE.)

12/22/10 ------- Touch (Email for Post Decision Activity on EAD saying that a letter of approval has been mailed out)

12/24/10 ------- Received EAD in the mail

12/27/10 ------- Applied for SSN

12/31/10 ------- Received Interview letter

01/03/11 ------- Received SSN card in the mail

01/07/11 ------- Mailed out response to RFE (I-693)

01/15/11 ------- Email confirming USCIS received RFE response

01/31/11 ------- Approved!

Pre-Adjustment of Status:

2006 -------- Met Online

02/07 ------- Visited him in the U.S. for what was suppose to be a few weeks (Came in with birth certificate and health card. Health card expired a few months after)

08/07 ------- Decided to get married because we didn't want to be apart (in the U.S.)

10/10 ------- USCIS Medical Done

Give us the links, please, I think everyone will be grateful and me, too.

Following this logics, everyone who got married and didn't apply for the GC within three months should be deportred. Did I understand you correctly?

those who got married but have not applied for AOS are out of status...if nobody tells on them, or they don't get caught in the street w/out papers stating they have a legal status, they're safe...if they're caught and have a non-legal reason as "no money" they will be sent home.

K-1's become out of status once their I-94 expires (a K-1 is a one entry only visa)

K-3's become out of status once their K-3 visa expires.

Hence, if they get asked for proof of status by an ICE officer and don't have it; they will be put into deportation proceedings.

So I guess you need to borrow money from your family or your husband's relatives.. for your AOS..

Take your NCLEX exam after having your Greencard.. Don't stress yourself while reviewing.. you need to focus on your review.. I know how you feel..

A..Right away, or at least right after your honeymoon. You should make every effort to get the Adjustment application filed within 90 days of the fiance(e) entering the United States, which is when the K-1 status expires, as indicated on the I-94.

So I guess you need to borrow money from your family or your husband's relatives.. for your AOS..

Take your NCLEX exam after having your Greencard.. Don't stress yourself while reviewing.. you need to focus on your review.. I know how you feel.. and it's quite expensive.. for the application I guess you have to pay $100+, that's for the board of nursing then for the pearsonvue if i'm not mistaken it's $200..
