hello! i'm new here in Vj but i need some info about the CR2 visa of my son. well he came here last aug '09 under CR2 visa and he is 10 years old. i came here under k1 and still married and i am already on the process of removal of condition of my 2 year gc. we sent in our paperwork a week ago and they sent it back with a note that since my child came here after 90 days of my k1 visa which was already close to two years and it states that he will not be included on the removal and need to file a separate form + another payment for that. so we changed the form and just me who is going to file for removal.

to make it short, my son's gc will expire in two years just like mine. he is under my husband's name which is the petitioner and just wondering what will i do later on to extend or renew his GC before it expires in 2 years? i thought i can include him on the removal of conditions but i think i cannot. :( i just want to be in track on everything so we would know what to do next. so... does he have to file a separate form for that? will that be 90 days before his gc expires just like his momma? and if so, what will be the requirements he needs? whose name will i write on the petitioner's name? will it be me already if i get my 10year gc or will it still be my hubby? or.. can i go ahead and apply for the extension or removal of conditions now with a separate form and another payment as well so we can have the same path?? i dunno.. need some help on this. if i can file for him now we can do that but it will not be the same dates cuz we already submitted my papers and i am thinking what will be the requirements he needs? and also, we still need to save money for the fees anyways :D but i just want to go ahead and gather the best info so in the future we will be able to do it without any troubles :)

You are applying for ROC or AOS now? You said ROC but this is not right if you only came in on K1 in August.

Feb 23 - Sent USCIS a message asking for a processing update

May 6 - Received an email response saying things were progressing normally but that waiting times might be longer

Mar 17 - got email, attached to one case number only, saying that my A number was changed relating to the I-130 filing

You are applying for ROC or AOS now? You said ROC but this is not right if you only came in on K1 in August.

Oh sorry for the confusion as Im new here so I did not explain it right. Well I came in here on K1 visa (2007) and got a 2yr gc dated dec07 so basically i am in the process of roc cuz my 2 yr gc will expire dec09 and my concern was my son just came here this aug09 with a CR2 visa and got his GC only good for two years. we filed for my roc 2 weeks ago and they returned it stating that i cannot include my son for the roc because he didn't came here during the 90days period of my k1 status which was way back '07. so my question now is what will i do if i have to renew his gc since it is only good for 2 years. will it be like 90 days before expiration too just like mine? i hope someone will respond but if u think i need to elaborate more of this, thats fine... i always check vj forum from time to time so an answer will be greatly appreciated. :)
