Hoping someone can help clarify this for me...

My fiancee and I are trying to figure out if it is better for us to get the K-1 or get married and get the CR-1.

One of our main concerns is how long it will take for her to be allowed to work after entering the US, and what restrictions apply to her work status.

Also, we would like to know which one takes longer to get. (I am aware of the guides and timelines, I am just a bit confused)

It seems that the K-1 is faster for her to enter, but the CR-1 has more benefits. Is this correct?

I am posting this concern both in the CR-1 and the K-1 forums, since it applies to both. Any help is appreciated.

AOS, EAD, AP:

07-22-10 : Sent packet

07-23-10 : Delivered

07-29-10 : NOA1 (all 3)

08-31-10 : Biometrics appt

08-31-10 : I-485 case transferred to CSC

Touched 09-01-10 (I-485 and I-765)

09-03-10 : Transfer hard copy

Touched 09-09-10 (I-485)

09-13-10 : I-765 & I-131 Approved!

You are correct!

The CR-1 takes longer to receive, but the AOS is complete and she has a passport stamp allowing her to work immediately (as sson as she gets an SSN)

The K-1 is processed faster but is only "half done" when she arrives. You have to get married and file AOS. She cannot work until she has an EAD or Green Card. You must get marreid and then file and then wait 2-6 months for the green card. EADs are usually issued in 90 days or less. So her "time to working" is probably the same.

If your fiancee being able to work is a major consideration, then the CR-1 is the best route for you. Another item of "delay" is that you can file for a K-1 today. Doing a CR-1 will require you to travel back and marry her first.

Thanks for all the info! I actually am with her now in France, and thats why we are trying to figure out what the best route is before we start anything.
