Hi,

I would like to know if 1040EZ tax return is really that important as to support the Affidavit.

I do not have a copy and as per IRS it will take them 60 days to provide me one and have to pay $60.00 for it.

Would like to know if someone here have been approved on the k1 without the 1040EZ.

Please, please HELP!!

Call 18008291040 and order a TAX TRANSCRIPT (these are free and take 5-10 days usually to get to you) not A COPY OF YOUR TAX RETURN (these cost $57. because they have to go look for them in their files and copy them for you).

DO NOT listen if someone tells you "you don't need a copy of your tax return" because that is a load of garbage. Look at the Manila website http://manila.usembassy.gov/wwwfk1en.pdf and read the following from their list of required documents to bring:

n. EVIDENCE OF SUPPORT. You should be able to demonstrate that you will not become a public charge or be a burden on the U.S. taxpayers for financial support. A completed I-134 Affidavit of Support Form will be useful to the consular officer to evaluate your petitioner’s ability to be financially responsible for you. You should also submit your petitioner’s most recent U.S. Federal income tax return (Form 1040) and wage statements (Form W-2). Employment letters stating salaries and bank statements may be included to substantiate the I-134. Download Form I-134 at http://www.uscis.gov/portal/site/uscis.

Notice where it says you need to bring "You should also submit your petitioner’s most recent U.S. Federal income tax return (Form 1040) and wage statements (Form W-2)"

You can substitute the 1040 and w-2's with the tax transcript, which is the IRS version of your tax forms. I did it and I can tell you POSITIVELY you can also.

Tax Trasncripts for free from the IRS are even better. (I am sure you'll do a better job of keeping of copy of future tax returns; recommendation is 7 seven years).

You don't need them but they do help.

For her interview, I sent the last three years transcripts (took about 3 weeks to get and for free), letter from my employer, and closer to her interview date, I'll scan and email her my three most recent pay check stubs.

thanks! Yeah i just got off the phone with IRS. though i was on hold for 1 hour. they faxed me my 1040 transcript.

Her interview is next week so am all stressed out right now.

One other question, how long did you have to wait when you filed for your I-485 Change of Status? Is it within a time period like 3 months?

ASAP after you are married, hopefully by time your 1-94 expires. But many people wait longer.

Phil, for personal income tax, 3 years is all that is required. They cannot go back farther than that in an audit of personal taxes and you cannot go back farther than that in amended returns. When I do my 2009 return, I will shred the 2006 return. I do not keep them for 3 years and a day.

I garee with everyone, do not attempt going to the interview without a tax return or transcript for 2008 minimum
