Ok, we got married March 8, 2007 .. and when he filed on 2008 for year 2007, also in 2009 for year 2008, he included me with my TIN. We got tax transcripts for 2007 and 2008.

As soon as I receive my EAD card, I will apply for SSN then talk to a tax accountant :thumbs:

Are we still going to get more $ if we revise it eventhough my husband was the only one who's working since then??

So... Someone with an ITIN doesn't get as much as someone with a SSN?

Ok this is what happened in my case.... tax guy said we would be getting 5k using my ITIN. After bout a month i recvd a letter from IRS saying there was an error with my SS number or it was incomplete (obviously i didnt have SSN yet). When check arrived, we only got half. I went back to tax guy and said it was because IRS revised their rule or something. During that time I already have my SSN so they revised the tax return, mailed it back to IRS and after about 2-3 months , we got the other half.

To answer your question... someone with ITIN will get as much as someone with SSN, its just that you wont be able to get everything until you have your SSN. That is how i understand it based on what i experienced. Im just not sure if you can revise the tax return again when you get your SSN because you already had it revised from single to married. In our case, it was the first and only time my wife filed for tax return thats why we only had to ammend it once.

It seems like the error in the check was based on an error done by the IRS (thinking you had an incomplete SSN). Once they figured things out, they corrected it. Although, I could be extremly wrong. :)

I have faith that we'll receive the whole amount. I hope we do; it's not much, but when you're dirt poor, it doesn't hurt.

12/27/10 ------- Applied for SSN

When your husband files the AOS for you he needs to show his tax returns for the past 3 years!These tax returns need to include you as well!

how so...my hubby doesn't even have a SSN and i was told and have seen on tax forms that if you are married to a foreign spouse without an SSN, then you must check off single...

the first year we applied for the itn number married filing joint....he didnt get the number... so they(IRS) changed it back to married filing as seperate. After he got here this year, got his social sec number we just did revise and send it off But the minute you marry YOUR ARE MARRIED starting the first second for that year no matter if married in Nov etc

Could they have meant "foreign" as in "not currently residing in the country"?

At any rate, my information comes from VJers and H&R Block. We have the appointment with them next week. I'll have more info then.

well, even when i go to employment agencies and fill out the w-4s they have, it says to put single down if your spouse is a foreign one and doesnt have an SSN....damn it, and i filed my ####### online....will this affect our case? :(

My Brother had encouraged me to file single when I got married because he and his ex-wife did that at first. Thankfully I went to H&R Block that year because I had more complicated taxes since I had my own business for six months the fiscal year prior. They told me I had to either file as married and get an ITTN number for him which it was nearly deadline so it wasn't really an option unless I filed for an extension or they told me I had to file Married Filing Separately. I didn't believe them at first since my Brothers advice about filing single so I called the IRS to ask them. I got this special department for those married to foreign spouses who are still nationals of another country. The man was very good and very through and even looked up in the policies and procedures and read the sections for me and translated them to me like a college professor. I wondered if he was the department head or he'd just been there a very long time and likes to do a good job. He even explained to me that my Husband would fall under "World Wide Income". We eventually came to the conclusion that until my Husband was here I'd file married filing separately so I went back to H&R Block and paid the $150 for her to do my taxes. For three tax years now I've filed married filing separately and last year I saw that once we revised my last three years of taxes to filing married that we'd qualify to get $432 back. I'm not sure how that's going to work since he went and asked the hospital he worked at and the Military for some sort of tax form showing what he made for the year and they both got defensive with him asking why he needs some paper like that. I guessed they don't have a tax system there like we do here? I still would like to revise them though for AOS to show proof of marriage though finances even though I've been a student since 2007 and haven't made much money to file this next year when he should be with me. Crossing my fingers. X

exactly, YOUR MARRIED so the choices are if he would have had the ss number or ITN then you could do jointly, if not, married filing seperate. Once here get the number and refigure the back years, and the first year with the number now you can say jointly

I dont believe his income there will even be included here because he didnt pay US income tax with the wages received, for there i have no idea how their tax system works
