My husband was advised, wrongly, that because I didn't have a green card, he should file as a single man.

I just spoke with H&R Block and they are appalled. lol

They said that they can revised his taxes and that we will get about 1000$ per year (he usually gets 1000 in refund as a single man). We can hire a lawyer! :dance:

When my wife filed her tax returns for 2008, the tax guy from jackson hewitt said we will be getting 5k earned income credit if we filed jointly. So i applied for ITIN coz at that time i didnt have SSN yet. After 2-3 months the refund check arrived in the mail. We only got around $2500. I called the tax company and they said it was because i didnt have SSN and that is why we did not get the complete amount of 5K. We were told that at the time i applied for ITIN in March, the rules have been changed. Good thing i already had my SSN and they revised my wifes tax return for free because they didnt tell me the first time. we recvd the remaining balance now but we had to wait another 3 months. Double check with H&R Block if you would be getting the 2k refund with no problems. Check the link below for the instructions on the revised W7 form.

No I mean, I figured that the amount I will get with an ITIN is the same as I would if I had a SSN.

What if in our case,

I'm only in f1 visa when I got married to my husband .. 2007 - he filed as married w/ his SSN and my TIN, 2008 - the same.

We only got small amount because he wasn't working full time in those years, plus changing jobs.

I'm currently in my AOS process and will soon receive my EAD card then apply for SSN.

Can we claim something?

if you got married in 2007, on or before 11:59 pm on December 31, you are supposed to be on the 2007 tax return. it is not too late to file a revised return. you WILL get some cash as a result. get your SS# and see a tax accountant before the end of this year.

Ok, we got married March 8, 2007 .. and when he filed on 2008 for year 2007, also in 2009 for year 2008, he included me with my TIN. We got tax transcripts for 2007 and 2008.

As soon as I receive my EAD card, I will apply for SSN then talk to a tax accountant :thumbs:

Are we still going to get more $ if we revise it eventhough my husband was the only one who's working since then??

I just called h&r block, and the lady told me that, NO I can't ammend even if I could get a SSN soon .. she also said that once I get my SSN, it's just the time I'll use it .. because, when we filed married filing jointly in 2007 & 2008, IRS accepted my ITIN, so we're not getting anything, anymore :o

I just called h&r block, and the lady told me that, NO I can't ammend even if I could get a SSN soon .. she also said that once I get my SSN, it's just the time I'll use it .. because, when we filed married filing jointly in 2007 & 2008, IRS accepted my ITIN, so we're not getting anything, anymore :o

Sounds about right. I was told that we can revise our taxes because my husband had filed as a single man. That was wrong and we are correcting that mistake. But since, from what I've been told, the ITIN and SSN are (as far as taxes are concerned) basically the same, it would do no good to revise, since they would come out the same.

11/10/10 ------- NOA1 received for I-130, I-485 and I-765 (emails)

11/12/10 ------- NOA1 received for I-130, I-485 and I-765 (hard copies)

11/12/10 ------- Touches on I-130, I-485 and I-765

11/19/10 ------- Biometrics appointment letter received

12/06/10 ------- RFE for I-693 (I think the issue is that it was not signed. Called USCIS and will receive a letter in a few days explaining)

12/13/10 ------- Biometrics done

12/16/10 ------- EAD card in production (email)

12/20/10 ------- Received "Letter of Explanation" for RFE (Service Request to expedite my case. Called USCIS and was told to ignore that and just send in response to RFE.)

12/22/10 ------- Touch (Email for Post Decision Activity on EAD saying that a letter of approval has been mailed out)

12/24/10 ------- Received EAD in the mail

12/27/10 ------- Applied for SSN

12/31/10 ------- Received Interview letter

01/03/11 ------- Received SSN card in the mail

01/07/11 ------- Mailed out response to RFE (I-693)

01/15/11 ------- Email confirming USCIS received RFE response

01/31/11 ------- Approved!

Pre-Adjustment of Status:

2006 -------- Met Online

02/07 ------- Visited him in the U.S. for what was suppose to be a few weeks (Came in with birth certificate and health card. Health card expired a few months after)

08/07 ------- Decided to get married because we didn't want to be apart (in the U.S.)

10/10 ------- USCIS Medical Done
