Can my fiance get a work authorisation permit at the POE?

Hello, All!

First of all, thanks to all, who already helped us very much in our journey. Right now, I have another question that I heard controversial views about. I hope that someone here will be able to clarify this for me.

My fiance is entering U.S. with the K1 visa. Can he legaly get an authorization to work right away (while waiting for the status adjustement)? I heard that legaly he can get a stamp in his passport at the POE that will allow him to work for the first 90 days, while waiting for the status adjustement.

Is this ture? If yes, is there a link with the document that will state this right?

True, but there is no such "right". That's just something he can ask for at the POE. To the best of my knowledge, the only POE where he would actually have any reasonable chances of getting EAD is JFK.

But, it never hurts to ask.

In my opinion that 90 days stamp is worthless in regards to gaining meaningful employment. Your time would be better served by getting married as soon as possible, getting all of your paperwork in, and then sitting back and getting acclimated to the US, looking at positions, getting a feel for the job market, etc.... All that stuff takes time... a perfect use of 90 days or so...

No employer other that extremely temporary assignments is going to hire anyone that only has 90 days of employment authorization...

All couples should budget for at least 4 to 6 months of not having employment.

Point of clarification - your fiance will be employment authorized when he is admitted to the USA, it comes with the K1 status. And this will be sufficient for him to get a SSN. What he won't have is an employment authorization document - a document that an employer must see to meet the requirements that the goverment places on an employer to verify a person's employment authorizaton status.

JFK airport in New York is known to put an 'employment authorized' stamp on the I-94 of people who are admitted in K1 status. Houston also, and maybe still the Detroit terrestrial POEs.

They kept my fiance in immigration for 7 hours. They would of laughed in his face if he asked for a work visa. I agree just do it fast and he will be working soon!

James got one at JFK and it is just a tiny little stamp. However, he has not tried to use it (having LOTS of trouble getting the SSN).
