Okay we are wondering if we need this decree from the courts? The father is not on birth certificate and the boy has the mothers last name. And he is no were to be found. So do we still need this decree form the courts? Is this only for when the you have 2 parents on the Birth Certificate?

Okay we are wondering if we need this decree from the courts? The father is not on birth certificate and the boy has the mothers last name. And he is no were to be found. So do we still need this decree form the courts? Is this only for when the you have 2 parents on the Birth Certificate?

Oddly enough you do not need the court decree but Ukraine requires a "certificate of no father". A seemingly impossible title to a document but they do have such a thing. Your fiancee can take the child's birth certificate to the "ZAKS" office in the "capital city" of her Oblast where these offices are located. It is a fairly common document and she may be aware of it, if she isn't, one of her friends is. Alla has one she still carries around, though she is long past the age of needing it. There are lots of instances of "no father" in the FSU. This is really a holdover from Soviet times when a mother was not allowed to do anything for child, not even get medical care, without the permission of the father or by having one of these documents.

Alla has translated lots of these documents.

This will be all you need for the interview. It is required by Ukrainian laws and the US consulate has little choice but to go along with it for the issuance of a K-2. She will also need it when she leaves the country with the child, she may also need it to get the child a passport (their own passport) Children getting an international passport of their own need the permission of BOTH parents or this document. The child can be added to her passport without it or without permission of the other parent.
