Hello VJ members.

I have a question about the next situation: My husband received the CR-1 visa on September 4, 2009. If our relationship is no longer to be continue, how can I revoke the visa and do not want him to join me in USA? He has 6 month visa expiration. He is still in his country and cannot come to USA shortly. What should I do in that case, who should I send any letters about do not give him an entry to USA? Please help. Thank you.

A consulatation with a qualified immigration attorney may be a good idea. You have executed an I-864 that would also be in force.

I have a question about the next situation: My husband received the CR-1 visa on September 4, 2009. If our relationship is no longer to be continue, how can I revoke the visa and do not want him to join me in USA? He has 6 month visa expiration. He is still in his country and cannot come to USA shortly. What should I do in that case, who should I send any letters about do not give him an entry to USA? Please help. Thank you.

it is cases like THIS that make it harder for people like my love to receive a visa.

Unfortunately real couples pay the price for the mistakes people like you make. If you really loved him at one point, why would u want to stop him from going to the USA? Just because you are separated now? My Goodness!

I take a different approach.

Since you married him, and now do not want to be married to him - it's on yer head to file the divorce paperwork.

If he's not left the country - it is possible that the Consulate can revoke his visa, if you write to them (email or fax ) stating that you have filed divorce proceedings, and include a copy of the initial filing documents.

Sure, it's all convoluted - but it IS possible to revoke the visa if he's not jumped the pond yet.

I know it's been a while since you've posted - perhaps by now you've made up your mind on WHAT you want to do?

This is pretty harsh. You have NO idea how long they have known each other or the situtation that caused the separation. To insinuate they were not a "real couple" is insulting. Unless you know more about the situation the OP is in or what caused the break up, this is totally uncalled for. Exactly HOW are are "real couples" paying the price for this broken relationship?

If you have proof he was just doing the process for the GC and didn't marry you with good faith you have a chance. Otherwise there's not much you can do unless he did something illegal like lieing to immigration.

Why do you want to stop him coming?

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Too late. he has the visa and it is a CR-1 which means he gets a green card upon arrival. He will likely not be able to lift conditions but there is nothing you can do to stop him from entering the US.

True, you should cantact USCIS for your own good and you can withdraw the affidavit, but that does not revoke the visa already issued. It may stop him from lifting conditions. For what it is worth, OK, if the realtionship didn't work out...it happens. Hey I am divorced from my former USC wife and I can't get her out of the country either! And this country is barely big enough to hide from her! I hate sharing the same planet with her, so it wouldn't matter anyway. You can only protect yourself for the future, don't worry about him.
