Im in search of a good lawyer (cheap price if possible) can you guys recommend me a good one.

Los angeles area preferred..

My case: entered as k-4 visa and had never apply for AOS because the petitioner withdrawn it. Our I-94 was expired last jan 29/06.

Not everyone needs to hire an attorney though...the process is pretty straightforward if you can follow the directions given in the guides and on the forms. 95% of us on here haven't used an attorney and have been successful. :D

However, with that said...how can you file an AOS if the petition has been withdrawn? Methinks that's not gonna be a possibility, but then again, I know very little about the K4.

Ok.. forget about the k-4 visa. I got married then i want file my own AOS and the reason i need a lwayer is

I overstayed already for 5 months here.

We know already that we don't have any chances to push through our k-3/k-4 AOS application because it was withdrawn by the petitioner and the only way to get a legal papers here is to be married again a new US citizen.

K-1/k-2 Is different from K-3/K-4 visa.

You can always google for a K4 lawyer, lots came up when I was searching for this.

It sounds like you should be able to adjust your status based on your marriage, and that the only time the K4 will come into play here is under "Status at Entry" (or whatever that question is!). My suspicion is that the overstay will not cause you a problem for the AOS itself, but a consultation with a lawyer would be a good idea. Unfortunately, I don't know of a good one. You may wish to PM MissLiss, who talks of a lawyer who has online chat sessions.

You would be well advised not to leave the country (with or without AP) because of your overstay. I believe a 3-year bar on reentry is triggered after 180 days of unlawful precence, and you're awfully close to that point.

Yes if you married a US citizen, entered on a vaild visa (your K-4) but overstayed you should be cool based on what you told us so far, but I do suggest you get a good lawyer, I will pm you with the details of a good lawyer in LA.
