1st time post, 1st time filing

This is my first post. My name is Marcelo. I am a US citizen. I’m writing because I need some advice on filing for permanent residence for my wife, Usha, who is from Nepal.

Here’s a brief description our story:

We met in Sept. 2005. I was running in a Subway sandwich shop in Bridgeport, CT. Usha was with some friends who were looking for a job. This is where we first met. It’s funny because I had no attraction towards her at that time.

After some time, we began to see more of each other through mutual acquaintances. I remember the first time I looked at her as something other than a mutual friend was one day she was over where I worked and I happened to be leaving. I ended up giving her a ride back home. Well, a song came on (Outside by Staind) and he started to sing a little of it and it blew my mind. I would have never guessed a girl from some other country would like the same kind of music. After that, we started talking. I actually have date when I consider the first time we made a conscience decision to meet and hangout. I call it our Sunday (November 20, 2005).

Now since that time, we have been struggling to get Usha’s parents to except us as a couple until this year. In between these times, Usha has moved to different locations from CT to NJ and from NJ to MD.

Our current situation is that I live in Connecticut and she lives in Maryland. I am going to school and will be done in May 2010. Usha is working in a full time job as a software tester and is well establish with the company. She has an H1b status with the company. Her parents came from Nepal to visit on Feb. 20 this year and finally gave our relationship approval. So on April 23, 2009, Usha and I got engaged. We didn’t set a date for marriage, but we were planning to have it done in May 2010 after I graduated. Things changed. We decided to do it on Aug. 7th, mostly because her parents were around and I wanted them to be involved. Obviously, the wedding wasn’t anything big or complicated and we were both okay with it.

Now here we are married. Her family wants us to go to Nepal and do a wedding ceremony there for her side. We are looking at May 25th, 2010 as the date to fly over.

We don’t know if we should apply for a green card for her or wait till after we come back from Nepal.

We went to a lawyer for a consultation, but I don’t think we can afford their services of $2500. Especially, since we want to fly to Nepal and have a wedding and I am only working part time at the university I attend.

We are pretty sure that we need to file an I-130, i-864 and i-485. We don’t think we need to worry about i-765 or i-131.

We are going to start gathering information, like tax returns and phone records and whatever else we need this week. Thanks for listening or reading everyone. We just wanted to share this and document how the process goes. And obviously, ask questions when we get stuck. Thank you for your time.
