Husband has never been in the US-How to answer the following question?

Anywho, vjers I need your input here, some questions are straight forward but i am afraid to make a mistake and get an RFE for the wrong use of NONE and N/A...

My husband has never been in the US, therefore he has no Alien number or Social security number.

For questions C. 10 and C.9 on form I-130 :

9. U.S social security number _____

10. Alien Registration number ______

Should I put NONE? of N/A?

I was thinking to put N/A since he has never set foot in the US before, I'm I right?

I hope i haven't used up my stupid questions coupon in the forum yet

Hi there, Terca. Your question isn't silly in the least.

I'm guessing that you've completed the immigration process and you're embarking on your AOS process. Welcome to more happy-fun-time with the USCIS . For the first answer to your question, your hubby can apply for a social security number even if he's not a USC or resident. This means a mosey over to the local SSN office to get one you just have to fill out a form and wait 'til your number's called to chat to one of the representatives. He'll need one sooner or later, so I would strongly suggest that you guys get it now.

Secondly, his A-number (Alien Registration Number) should be located on the back of his I-94 immigration card, stapled into his passport. When the USCIS starts sending you notices once the process has started, it'll actually give the A-number on the documents themselves.

While you could put N/A, it's better to get the SSN and you've already got your A-number.

If noone applying for a IR1/CR1 visa could have a previous A# or a social security number then N/A would be correct. However, it is possible to have had a previous A# and/or SSN. Since he did not, the correct answer is None. N/A is an inappropriate response to those 2 questions.

I stand corrected. Sorry, it's that time of the morning and I'm feeling super-helpful...my apologies for the confusion. I misread that line to mean that he'd just stepped into the US.

For future reference (since this is in the IR-1/CR-1 section) IR-1/CR-1 does not do Adjustment of Status in the U.S.

N/A means "not applicable", so you only write it where the question does not apply to him/you (as applicable). In this case the question DOES apply, so you should write "None"--as in, "I have no A# or SSN". If you are a native born us citizen, you could answer N/A to the question of Alien Registration Number as that question is not applicable to your situation.

When ever you do use N/A, I would explain why. For example, in question 11 about prior spouses, assuming you have never been married, it would be weird to write "None"--as in, "my prior spouses have no names"-- I might write: "N/A (never previously married)". This makes clear WHY the answer is N/A and you will avoid the RFE.
