AOS question!

My friend came to US with K3 visa and her I 130 is approved,

her husband didn’t apply for AOS, can she apply by herself,

if he don’t want to apply for her?

Your friend can apply for AOS as long as her husband is willing to cooperate. She will need an affidavit of support from him as well as proof of a bonafide marriage. If she gets called in for an interview, her husband will be asked to attend it as well. This is of course under normal circumstances. There may be ways around this requirement in case of clearly documented abuse by the USC husband (I think VAWA can be invoked in that case but perhaps others can chime in).

Can a friend do the affidavit of support for her or she will need his?

Is he obligated my law to help her to do the AOS?

I think their marriage it’s not working out, that the reason why he doesn’t want to apply for her

He is not obligated by law to help her with AOS at all.

If the marriage isnt working out already, can she go back home to her family for comfort and support?
