Filing for the I-485

Hi, I brought my wife here originally on a k-1 visa & we just got married. So were getting ready to file the I-485 Adjustment of Status this week. So, I just want to get some clarity before I actually send the paperwork.

My biggest concern was just with the name change. Her SS # is still in her maiden name, & the marriage certificate only displays her maiden name. So I'm confused as to what proof we have of her name being changed. Is being married enough proof? I know these questions have been asked repeatedly, and I have went through several responses. But I'm just not sure especially with the Marriage Certificate only having her maiden name.

I'll probably be posting more questions as they come. Thanks in advance

Yeah seems strange but you can put her married name on the I-485 and she'll get the GC in it. It's official.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

!! ALL PAU!

Yeah, It seems to be normal procedure from reading through the forum. I just haven't found any clear cut answers, from the USCIS or internet regarding this. Anyways, Thanks for the quick reply!! much appreciated

it's ok that her SS is in her maiden name, all she'll need to do is go back to have it changed to her married (current) name with your marriage cert as proof)

as for the marriage cert, it's normal that it shows her maiden name because it needs to show who the contracting parties are (to show 2 single parties)

the name that will show on your wife's GC will be whatever name you put on the AOS application. i used my new name as my last name and that's what i got on my GC

It's because when you marry its you marrying the girl with the maiden name, not the girl who took your last name....that is why the marriage certificate is always in the maiden name. Choosing to change that happens after marriage.

Sorta like Billy Bob Wilson marries Suzie Q Jones not Suzie Q Wilson :D

Your marriage certificate show that you were in fact married and are now legally able to change her last name if she so chooses.

Right, and what does she have to do to legally change her name? Is getting married the only thing she needs to proove the name change? Does that make it official?

as the one applying for AOS, if she puts her name using your last name as her new last name, is declaring that that is what she wants her name to be, and what's her GC, EAD and AP will show. she also goes back to SSA to change her last name to the new last name, and indicate the same new last when she applies for driver's license, credit cards, a job etc.

Okay, great. Thanks for the response. The SS office here won't let me change her name on the SS card until I have went through immigration & the new name appears on the green card. Then they said thats when they can change it. That sound okay, just wait until the green card comes through and go back to ss office afterwords to have it changed. Okay, thanks again. I seem to be getting things straightened out!!
