I 864 + female USC + Married Name

Hi!

All these example forms are for male petitioners! Since I'm a girl petitioner, and I want to use Nik's name, I have this (sentimental) wish to sponsor him with my new name -- But I'm afraid that it won't show up as matching his petitioner.

So, do I have to fill out the I864 in my maiden name or can I fill it out in my new married name? Should I wait until I've changed it on my SS card and other IDs? We had planned on filing pretty soon after we had the marriage certificate, but I could wait until I'd gone through and officially changed it elsewhere, if we have to. There's no field where you can put previous names used like there is on the other biographical detail questions on other forms.

K-1:

January 28, 2009: NOA1

June 4, 2009: Interview - APPROVED!!!

October 11, 2009: Wedding

AOS:

December 23, 2009: NOA1!

January 22, 2010: Bogus RFE corrected through congressional inquiry "EAD waiting on biometrics only" Read about it here.

March 15, 2010: AOS interview - RFE for I-693 vaccination supplement - CS signed part 6!

March 27, 2010: Green Card recieved

ROC:

March 1, 2012: Mailed ROC package

March 7, 2012: Tracking says "notice left"...after a phone call to post office.

Use your legal name at the time of submission. If you take his name at marriage then it's legally you, Heather NiksLastName. A copy of your marriage certificate would address any questions. I can't imagine that you would be the first.

Heather, this is because you are a rare and wonderful American woman that can attratc a foreign man.

Do not let being sentimental cause you problems. Sentiments are best kept to oneself anyway. Of course this is for the I-485 which means they have your marriage certificate and SHOULD be able to figure this out, but it IS the government which means if you are so sentimental to actually do this, I would include a letter of explanation.

Remember you do not have to do anything with USCIS to change your name, so it absolutely is not important which name you use for the I-864.

Yeah, yeah, yeah, Gary - I knew as soon as I saw your name there'd be something like this! :lol:

The best man (best friends with Nik since school) has been with us all weekend - I'm in for a good bit of teasing from all sides I see - bring it on! :D
