Is a "work authorization stamp" needed for K-1s to work pre-EAD?

In the Yahoo forum/group 'RussianBrideList' there's a current discussion regarding a fiance(e) working when entering the U.S. with a K-1 visa.

I brought my wife through JFK and got the small red initialed work authorization stamp. This was so that she could work before she had her EAD or green card. I've been corrected that this authorization stamp is not needed, and hasn't for many years. I've attached the pdf from the gubbermint's site, and a link to the file is pasted below. Look at:

"Table 5.1. Work Authorization, by Nonimmigrant Category" and "Appendix B. Summary of Selected Nonimmigrant Benefits (continued)"

You have a file from 2006 as a resource? You better look at the I-9 from February 2009.

Can only work if she has specific employer named on the I-94 and the plastic EAD card. Since this is not the case, get married pronto and file for AOS so she can get her EAD.

Thanks for the reply. In my haste to beat the after work rush to the gym, I failed to note we were married over two years ago. The other points you mentioned are completely new to me. Off to the gym. :dance:

yes, this information is seriously out of date and should not be referenced by anyone currently pursuing a K-1 visa. The situation changed in the Spring of 2009 so that the information presented in this 2006 document is no longer true.

That information is outdated, and should NOT be given much credence. We all need to be cautious with what we post. There is a pinned thread about working and K-1's in this forum.

Yup - Pinned Thread Is A K1 authorized to work without an EAD?, Here's the answer to the question

This is more of a "Working & Traveling prior to getting a Green Card" related question/topic.

The wording of the I-9 form changed in February, enforcement began in April. K-1s cannot work without the EAD. They do not have the necessary documents to meet the I-9 requirements. The CBP at JFK continues to waste ink with that silly stamp. For instance they gave one to our K-2 son and they have never been allowed to work prior to an EAD.

I made the mistake of not clearly stating I was referring to 2007. I didn't realize there is a new I-94 and new rules in effect. We were married Sept 7, '07 a few weeks after Tania entered through JFK, and filed the EAD and AOS(for 2 year green card) immediately. She got her green card March 2008.

I made the mistake of not clearly stating I was referring to 2007. I didn't realize there is a new I-94 and new rules in effect. We were married Sept 7, '07 a few weeks after Tania entered through JFK, and filed the EAD and AOS(for 2 year green card) immediately. She got her green card March 2008.

OK, great. She has a green card, that is the ultimate work authorization, she doesn't need anything else (except SSN). The EAD is a work authorization that you can usually get faster than the green card, but Alla got her green card first, happens that way sometimes. The green card trumps all others.

It's not the I-94 that has changed it is the I-9 form.

Well, let me change it to a hypothetical situation. Suppose my K-1 sweetheart comes through a POE tomorrow, first time in the U.S., and she wants to work as soon as possible. Suppose she finds something, they want her to start working next week. Her SSN / card arrived in the mail next Monday. Can she start working after she receives her SSN and card?
