Just curiuos about this question. Is deportation possible for a mom of a 1 yr. old US citizen baby?Would they really take the mom away from her baby?

Having a baby as a USC does not stop you from being deported. The baby can travel with the mother.

Yep, have seen it happen locally with illegal Mexicans. The baby is not taken away from the mother though: she is encouraged to bring it with her. If she chooses to leave the baby in the USA, she can make arrangements to have it cared for by a family member.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

status does not matter when it comes to deportation.. the child has its individual rights but the mother does not share those rights. If they say she goes.. she goes.. she can take the child or leave the child... dependant upon the fathers input on the child leaving the country and any legal rulings in place regarding the childs travels.

FYI the story here for happywifemom is the fact that she has documents that are not correct as stated in another thread, I am assuming now that the jig is up she is concerned about being deported for false documents presented to USCIS.

happy while I feel for your situation the comment about mexicans WAS TOTALLY UNCALLED for. You need to get yourself out of the mess that YOU created and hire an attorney as stated to you numerous times rather than pisting part of the story asking about deportation.

Why is it that the only one who can stop the crying is the one who started it in the first place?

:crying: Really Sorry about that . I did not mean to specify mexicans.I only replied to Penguin's post when he mentioned illegal mexicans.

ANd i apologize for that.

I am not trying to cover up my mistake with another mistake that is why i asked your opinions and was asking any recommendation of a good immigration lawyer.

And there are a lot of illegals here so i am not trying to mean of just one race. Like i said i only responded to Penguin's post.

No offense but how about you read the post before hers. She was replying to a direct comment from someone else. There was no need to be so offensive in your reply by calling her obtuse. You should be ashamed of yourself and apologise for attacking someone, let alone the wrong person.

Back on subject: Yes a mother can be deported, they would likely try to place the child wiht USC family since the USA is still responsible for all children born on this soil. She can face deportation and the child cannot save her from that... she can try to file but man she needs a laywer if her status isn't legal.

She is just replying to others reply regarding her query. Besides, she might be thinking that it might be a different case between illegal Mexicans and Filipinos that's why specify that she isn't talking about the illegal Mexicans. :innocent:

Penguin use some case of illegal Mexicans here as a best example to explain to her the situation so that she could understand what circumstances she might need to deal with. :whistle:
