Interview Soon Do I have to include taxes in I 134?

Hello,

Does anybody know if the embassy will ask to see last years taxes at K-1 visa interview? Do I have to send last years taxes with I 134?????????????

I did not make much last year, but I have been working very very hard this year so that when he goes in for adjustment of status, then I will qualify just fine.

I can supply all copies of paystubs for the past year- which will equal $26,000

plus I just sold my house and will be getting $35,000 from the sale of it.

But last year I think I only made about $10,000 and it was a joint tax return with my exhusband- who i was seperated from when we filed taxes but still filed together to make it easier.

I-134 does not ask for taxes unless you were/are self-employed. You WILL have to show them at the AOS stage, as it is required for the I-864. Be advised, any consulate can ask for anything at anytime before issuing a visa. They do not have to follow even their own guides. I would never suggest anyone go to an interview without the last year's tax return of the petitioner. I would, at minimum have it available for review. Last years income is usually not such a factor in a decision of your ability to support the intending immigrant, current income is given more weight.

This is ridiculous, why people keep trying to tell people they don't need tax returns. Yes it is not REQUIRED when filling out the I-134, but we all know that it makes life much easier besides the fact that most consulates require it. Why would anyone advise people to do something that may cause them delays or possibly a denial just because they think it's right. The info posted in the above link states to bring 2 or 4 things to substantiate the information provided on the I-134, tax returns are one of those items. Nigeria is one of the hardest consulates in the world due to it being one of the highest fraud countries known to mankind.

I think some people need to not answer questions unless they know for sure it is not gonna cause undue harm to a petitioner or benficiary, giving someone information to make them feel secure when chances are it is gonna cause problems is ludicrous.

Kiev, a much easier consulate than Lagos (OMG YES) "requires" exactly the same thing...2 of 4 items. I was there when a woman was told, without an interview question being asked (Kiev does not ask a lot of questions) "Everything looks OK with your visa and we can issue it as soon as you bring your fiance's most recent tax return" She did not offer that she had it with her, but I am not sure what would have happened if she did, they had already given her the blue slip requiring more information. Kiev interviews are more or less "public" being done at a window in the waiting room. Any questions or results are on view to anyone.

A similar situation occured when Alla went for our son's K-2 to follow in June of this year. So it seems, at least for Kiev, that you must have "2 of the following 4" items as long as ONE of them is the most recent year tax return. They don't tell you this in the instructions, they do not have to.

So I will stand with what I have said. I would never advise anyone to go to an interview without the most recent year's tax return. Further, I would not sit on it and wait for them ask, I would just hand it over. Current income is far more weighty than last year's income so what is to gain in withholding it? If the consulate says "2 out of 4" items. I give them all four plus two more.

I am filing at the same embassy as you are and my attorney had me to submit my tax returns transcript for the last three years. I also had to submit a letter stating how long I have been employed along with my yearly salary.

Just posted is a thread in the K-1 forum (it will probably be moved here) The beneficiary was denied at the first interiew for not having the 2008 return of his fiancee. He went back with a second interview and tax return with w-2s and was denied because it was not a transcript. He HAD the transcript with him at today's interview and offered it after they told him he needed it. Nothing doing. Come back again October 21st. Always bring tax returns for most recent year.
