I just signed up for the forum a minute ago, I feel like i should have done this a while back.. it seem as we are all here because the immigration process is a pita.. nuff said let me jump into things.

My wife and I met in school here in the states and started dating a few weeks later, almost 3 years later we got married here before she went home to finish her last semester in school in China. When she was here she was on a J-1 visa listed as 40.0601 for her skills list classification, and marked on the DS-2019 accordingly, although for those of you who have had to deal with the J-1 bs, all the categories are on China's skills list.. so good luck with the waiver..

So now for the time line:

Married: 12-08

Nats to China: 01-09

Submit I-130 > USCIS: 02-09

Approved I-130: 07-09

Kai to China: 08-01 - 09-09

Sent AOS fee (cleared 4 days later): 09-09

Sent Advisory Opinion about J-1 status: 9-19-09

Sent Agent form (accepted 1 week later): 09-09

Sent AOS: 09-25-09

Sent IV app fee (cleared in 3 days): 09-30-09

----( after a few months of trying to find out about the J-1, it ends up J-1 status will keep her from passing the IV application approval for another 14 months.)----

So now my wife and I have decided to file for the K-3 Visa so she can come here while we finish the J-1 waiver or wait out the 14 mo for the IV/Status Change(at that point).

I have already filed the I-130 from the IV process we were perusing, so according to USCIS I should only need to send in the I-129F. I have done my homework on the 129F about the process and the time it takes, and honestly at this point I am only concerned about the first 3 letters of our case number...GUZ

Our case, as for all IV, K1, K3, K4 cases for China go through the Guangzhou consulate. I'm just worried that eventhough the process is "claimed" to be a fast option for separated loved ones to be together that the good old GUZ is gonna bottleneck that claim..

Anyways, thats my intro to where we are at. My wife is from Wuhan so anyone in a simiar situation in Wuhan that wants to connect let me know. And if anyone has any insights for me they would be much appreciated~! Thanks

So your wife has 2-yr home residency requirement.

My former boss (USC) married a girl from Azerbaijan who also had 2-yr HRR. He worked in Balkans and she could not be with him as they required for the 2-yr HRR to be completed in her home country before the visa was issued - no going around that requirement. I hope your case gets processed soon but be prepared for a wait - some countries simply will not issue no objection waiver that easily.

K3 is no longer an option for you because the I-130 is already approved. An I-129F for a spouse can only be accepted when there is a pending I-130. Yours is no longer pending. You may simply delay the immigrant visa process until the two-year requirement is met.

Facts are cheap...knowing how to use them is precious...

It may be possible to get a waiver for the J-1 .. I'd stick with the I-130.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

It clearly says:
