How do you prove non-intent to marry?

My wife has worked for the same law firm for 23 years. She took Wens off for our interview and yesterday at work not one but TWO attorneys of some years standing asked her why on earth did you have to go for an immigration interview, you guys are married.

Ignorance is not the sole preserve of the lay person. :wacko:

Bumping this 'cause I think it's an important and pertinent read.

All of this is very confusing. You may not lie at POE but if you do, you may not be admitted into the U.S. You may not be denied for prior intent (according to case law) but you may be for misrepresentation. Imagine this scenario: CO--"What is the purpose of your visit to the U.S.?" Person--"Uh, immigrating/adjusting my status to LPR." I'm pretty sure they would turn you right back at the border and put you on the next flight home. And if you say "Visiting Disneyland and NASA," then you're misrepresenting yourself. Kind of a Catch-22.

I was just reading about a USC's parents being denied at AOS from a B2 because they filed within 20 days of their arrival into the U.S. I think they were charged with misrepresentation. In this case, it is misrepresentation of intent. Is it not? They did not lie at POE (visting their son for a vacation) and had strong proof of ties to the homeland. They just woke up one morning and decided to stay as they were getting old and needed their son's help in getting by. But looking at it logically, if they were not planning to stay and were completely unaware of the immigration procedures/forms then it's quite strange that they managed to gather all the required documents and file within 20 days.

So if prior intent is not grounds for denial, then why doesn't everybody do it?

I know people don't believe me, but prominent immigration attorney Shusterman in his radio show said that AOS up to day 30 is seen as the intend to immigrate, and from day 30 on the assumption reverses. One of these days I'll find the link again . . .
