I need more information about NOA

Hello Guys!

Good Day!

I filed l-751 based on marriage in good faith/ divorce last 9th Sept 2009. I finally received my NOA on 4th October 2009. My question is do I need to mail the NOA back to USCIS along with other supporting documents and two passport style photographs? The other documents they asked for are Tax Returns, Medical, Car Insurance, Joint Policy of Life, Joint Ownership of Assets, Lease of Joint Tenancy and etc. Since, I'm divorce to my ex are they still need these documents?

Thanks for your response, appreciated. The form is I-797, Notice of Action.

This the letter says.

Your conditional resident status is extended for a period of one year from the date of expiration on your form I-551, conditional status resident card. During the one year extension you are autorized employment and travel.

In order to further process your petition, you will be receiving a biometric appointment notice with a specific time, date and location to capture your fingerprints, photo and signature. You MUST wait for your appointment notice before going to the Application Support Center (ASC) for biotmetric processing.

Please Note: Conditional residents who are residing overseas pursuant to military or official goverment orders will not receive an ASC appointment notice. However, you must send two passport-style photographs.

If you have not already done so, provide supporting documents to assist USCIS in processing your petition and to establish eligibility to remove the conditional basis of your permanent residence. Please include a copy of the receipt notice with any supporting documents you submit. Such evidence may include, but is not limited to the following items;

: Lease of joint tenancy

: Joint mortgage agreement and/ or property

: Joint ownership of asssets

: Tax returns

: Birth certificate(s) of any children born from the meriage

: Joint policies of life, medical and/ or car insurance

Timeline

If you have submitted all of this then you are fine. If something is missing, mail it to them and also bring a copy with you for biometrics as well. It's not an RFE, it is a notice stating they are taking action on your case and you will be receiving a biometrics appointment letter soon. Get your documents in order. Make sure you have everything on that list there. Don't worry it's just a processing letter to confirm they have received your documents and they are processing your case. *hugs* smile

All these right here I haven't send them yet, the only thing I can provide is the tax returns and medical insurance. The rest I don't have it because we're both working overseas with different areas. His in Iraq and I'm in Kuwait so we no joint account support. We got divorce on 22nd August 2009, Do you think the USCIS still need all of these documents?

Timeline

They need you to prove that your relationship was real. You have to prove the validity of your relationship. You have to show them documentation that you entered the marriage in "good faith" and it just didn't work out. You have to show them that you were "merging" your lives together. Joint banks accounts, joint credit cards, medical insurance, renters insurance, anything with both your names on it, leases, affidavits from family, friends neighbors... anything that can prove that you were both married and you are not here to commit immigration fraud because you entered the marriage in "good faith". You have to prove to the USCIS that you did not intend on coming here simply to get a divorce and get your greencard by marrying a US citizen.

If you have your divorce decree file your removal right away. Don't wait for the 90 days prior to your greencard expiring.

Yes, I already did and received my l-797, Notice of Action three days ago. I am waiting for the biometrics appointment. My concern heres if I need all these documents below? Since, I filed waiver..

Yes. I think you need to submit it since I read the instruction packet and this is what I just found:

If you are filing to waive the joint filing requirement because your marriage has been terminated, also submit a copy of the divorce decree or other document terminating or annulling the marriage with your petition.

It says "also", so that means you need to submit all the required documents and ALSO the divorce decree..

Yes you still need to prove you entered the relationship in good faith and that you were merging your lives.
