Co-Sponser.......HELP!!!!!

Timeline

Hi , I do not make the 125% over the poverty level (about $1,000 short). I am applying for the CR-1 Visa for my wife. My mother said she will co-sign for me. She is on permanent social security disability and works part-time (her yearly income is over the 125% level). Since she is on permanent Social security/disability ,she has no tax-returns. What will she have to show the goverment & will there be any problems (with her as a co-sponser). From what I have read her & I will both have to fill out the I-864a. Are there any other form's she will need to fill out. Also when will I need the forms from her? I am at the beginning of the process now (I-130 & G325a). Any help will be greatly appreciated. I'd advise you to start as soon as you can so when the right time comes, you'll have these documents ready to send to NVC and speed up ur NVC process. As to the other question, I am not knowledgeable regarding SS disability benefits, but if I were you I'd call NVC in advance and speak to someone to get advice :thumbs:

You as the petitioner will submit an I-864 regardless of income.

If you and your mom live in the same household, and/or she has claimed you as a dependent on her most recent tax return she will complete the I-864A. If you do not share the same residence then mom would complete form I-864.

I do not live in the same household with my mother (She lives alone). Half her income is from permanant social security -disability. She also works privately for a neighbor . She is allowed to earn a certain amount (above the social security-disability) with out having to claim it.She said the neighbor will fill out a sworn notorized letter stating -The date my mother began working for her and her wage. Any thought's on this? Do you think I will have any problem's?

Then yes, you will have a problem. If your mother does not file a tax return, then she does not make enough according to govt standards... It has to be filed for and claimed... Under the table work (which is what that would be considered since she did not claim it) does not count towards actual income for immigration purposes.... If she did not file because she did not earn enough money, then she does not earn enough money to sponsor...

Someone can correct me if I am off-base, but judging by what you have stated, she does not earn enough to be a sponsor... I would search to see if there is anyone else who can sponsor you... You are free to give it a shot, but I would have a back up plan as it sounds like there are a lot of exceptions in there...
