On you I130 form did you state you intended to go with the I129f route, if you did then it wont. This is what happend with me. My on-line I130 status changed from Case Received and Pending to Approval Notice Sent. It was ny I129f status that change from:

- Case Received and Pending

- RFE

- RFE received

To this date my I129f status still hasn't changed. I received approval notices for both in the mail 5 days after being approved on Monday.

Call NVC - (603)-334-0700

option: 1-1-what ever the first 3 letters on the your receipt are-1

Quote them you I130 receipt number & you I129f receipt number.

You I129f shouldn't be dead. Both should still be active, if on your I130 you stated you wished to go down the I129f route. It is correct that I130 is the superior visa and will be cheaper for you.

No, I did not tell them I intended to go with the I-129F route or K3 Visa route. Being new to this process I just completed a I-130 application and sent it in with all the requested information (this was before I found Visa Journey). I did not attach a cover letter to inform them that our intent is to go with the K3 Process. What a BIG mistake....

However, after having found this site on the I-129F package; I made sure to include a cover letter where I informed them that the I-129F was being sent with the intent to pursue a K3 Visa. Now I fear it was a bit too late....

I just called the NVC (automated system) and found that yesterday, 10/5/09, they have entered our case into their computer system and have assigned it an NVC case number. Should I perhaps call and speak to an operator tomorrow and explain my situation or will it not make a difference?

What is the time difference between a CR1 and K3 visa? I know it is a few months but can anyone round it off a bit?

Maybe I should just let nature take its course....

Any suggestions anyone??? I would appreciate any assistance/help with my dilemma.

P.S. On the I-130, I may have made a mistake. Question #22, where it tells you to complete the information below if the relative is in the United States & will apply for adjustment status....Well, dummy me I did not read the entire thing & now realized that it also asks that if the relative is not eligible for the adjustment where will they apply for a visa abroad at which American Cosular post??? My answer to all of #22 was "N/A". Will this hurt our case & get our paperwork kicked back??? Help!

I have a quick question I sent our I-130 August 25, 2009 & USCIS sent our NOA1 September 2, 2009. On September 18th I sent my I-129F and was received by USCIS on September 21, 2009. On September 22, 2009 they sent me the Receipt Notice. Only for the very next day, September 23, 2009, to receive our I-130 Approval Notice.

My question is, will this cause my I-129F to get denied? I never thought my I-130 to get approved in only 21 days! Now, only for a one day difference, I worry our I-129F to get denied....What should we do? Wait to hear any news from USCIS or file another I-129F???

Please advice. I know the CR-1 route is the cheapest but I hear it takes longer than the K-3 route...HELP.

By law, yes your I-129F should be denied because there is no pending I-130. Unless there are step-children for whom you failed to file an I-130, count yourself very lucky indeed.

Another quick question, if most likely my I-129F, will get denied & I never metioned on my I-130, my intent to pursue a K3...do I have to do anything to change my case status from K3 to a CR1??? Because it just might have been already processed as a CR1, right?

Will the next step be the same with the NVC whether filing a K3 or CR1? Once NVC issues a case number as they have for us, what is our next step if I don't know how the NVC will process our case? (I'm almost 100% sure they are processing it as a CR1, right?).

There's nothing to change. You never had a K3 status of any kind. You filed an I-130 and it was approved. As a result, you are on the immigrant visa path. Just follow it.

There's nothing to change. You never had a K3 status of any kind. You filed an I-130 and it was approved. As a result, you are on the immigrant visa path. Just follow it.

So if I have no choice now but to go with the CR1 route (since my I-130 got approved before our I-129), does this mean I will have to restart paperwork all over again? I only submitted the I-130 and no other form to go with it for a CR1 Visa...How will the denial of my I-129f affect my K3 process. Is there anything I should be doing right now? Should I contact NVC and tell them I now want to pursue the CR1 visa? Oh my God, now I feel as if the fast approval on my I-130 may not be something to rejoice about.

Any suggestions?

Liz,

calm down and breath. It is a good thing that your I130 has been approved. This file will now head for the NVC and the process your file for the embassy. I got my correspondence from the NVC thru email, so watch your spam or add them to your contacts in your email. Don't worry about the I129f.

In short, you have no K3 process. It's dead. Follow the CR1 guide and the Lingche shortcuts from the Wiki. This is a good thing.

Yesterday, 10/6/09, USCIS sent me an email notification that our I-129f was approved and being forwarded to NVC. I'm so CONFUSED! Do I now contact NVC and tell them I no longer wish to pursue a K3???

What is the difference in processing time between a K3 and a CR1??? HELP!

Stick with CR1 you can get thru NVC with CR1 in a short time, Plus a K3 can get stuck in AP at NVC like mine did, while it was stuck in AP at NVC I finished the CR1 at NVC in 28 days. Best thing to happen to us, cause the K3 has been at Paris embassy for 3 weeks and still not heard from Paris on it, we already have interview for the CR1. Do yourself a favor, forget about the I-129F!! Best wishes.

No, you just make a choice. If your choice (the smart one) is CR1, simply ignore everything to do with I-129F and press ahead with the CR1. If your choice is the K3, simply ignore everything to do with the I-130 and press ahead with the I-129F and K3.

It's ok, ask all the questions you need too. I get really nervous too!

Ohhh, I live in the state of perpetual nervousness... hehe.... I am always waiting for something to go wrong! But in bringing my wife here we had zero errors...it just took so darn long :wacko:
