Does this letter of explanation look ok?

I wrote this letter to explain why my income has been so low for the past 3 tax years (as you will read). I have a full-time job NOW but I thought it might look bad that my previous tax years were SO low (and you'll read why ;)).

To Whom It May Concern:

I, Name, am writing to provide an explanation for my low income for the past three tax years (2006, 2007, and 2008). I was an undergraduate student studying at My undergraduate school name from 2005 to 2009. During my time at School Name, I only worked part-time as I was going to school full-time at the same time. I held many different jobs during the summers and during the school year but my total gross income never reached above the poverty level since I was still a student studying in school.

I graduated from School Name in May 2009 and began looking for a full-time job. I found a job in July and started working full-time (75 hours per week) on July 27, 2009. I am currently making My Salary per year (as stated in the letter of employment, also included with the I-864) which is more than 125% above the poverty level. I hope that this letter, along with my pay stubs from when I started working full-time, and the letter of employment serve as sufficient evidence for my ability to efficiently provide support for the intending immigrant (my husband, Name).

Do you think you can still get a co-sponsor for safety sake? It might be easier to do that than to take chances. You might want to ask your parents if their income is above the 125% for their household size. This is because the tax information from the last year is really what they will look for, although the new pay stubs will help. The last thing you want is for them to tell you based on so and so tax year, you need to have a co-sponsor. This is all for safety sakes, because the last thing you want is a hold up at the NVC and a letter saying that based on last year's blah blah blah, you need to file with a co-sponsor.

I would check the other postings as well, because there are some people who have had the same issue, and most of them received letters telling them to provide i-864 for co-sponsors. Search for affidavit of support in other forums

Well I am actually planning on adding my husband's income where you can list other household members' income. My husband is the intending immigrant and after reading through the USCIS instructions, we can use his income if it will continue from the same source (which it will) and because he is my spouse. My husband can provide his W2 and 2008 tax return plus a letter of employment stating that he makes WAY above the poverty level with his salary. Do you think that between the both of our salaries put together, this would be sufficient?

Well I am actually planning on adding my husband's income where you can list other household members' income. My husband is the intending immigrant and after reading through the USCIS instructions, we can use his income if it will continue from the same source (which it will) and because he is my spouse. My husband can provide his W2 and 2008 tax return plus a letter of employment stating that he makes WAY above the poverty level with his salary. Do you think that between the both of our salaries put together, this would be sufficient?

I personally don't think it's a big issue, actually current income is more important than past income and I think the letter is a good idea.

If I am understanding you correctly, since your Husband has a W2 from last year, he is already working for an American company? Anyway, sounds sufficient.

Yes my husband is currently working for a US company as he is here in a J1 trainee visa :) He will continue working there after he gets his GC so his income will continue from the same source. Thanks for your input! :thumbs:

Past income is really not an issue. My wife only had tax return or 2008 because she never worked. Her current job salary is over the poverty line and that was enough to get my greencard. We did not get a co-sponsor even if we could. You should be fine.

Timeline

The letter isn't needed. Your G-325 gives your history so the CO is aware of the student status.

From what you state you are able to demonstrate current, continuing income (for the both of you) that meets the income requirements. That is what the CO's are evaluating.

The letter isn't needed. Your G-325 gives your history so the CO is aware of the student status.

From what you state you are able to demonstrate current, continuing income (for the both of you) that meets the income requirements. That is what the CO's are evaluating.

Past income not as important, but I would still include the letter. By giving the information early on (your low income last 3 years) you avoid USCIS asking you to further explain your financial situation.

Your income+your husband's will be plenty. You are in the right track.
