Need help about problem I had in the past.

Hi Everyone

I had a few concerns I wanted to address and any feedback would be greatly appreciated.

This is my first time on this site. I have a question to ask you about the visa. In 2006 I came to the U.S with J1 visa, I allowed to work for 3 months and 1 month ( 30 days grace period) to travel. My DS 2019 started from 03-08-2006 until 06-09-2006. I worked with the first employer who signed me a job offer form for 2 and a half months.

Here is the story that may cause me a problem. I have made a big mistake!! I was bad!! I got fire from the first job from stealing some money. They told me to write the letter to confess that I took some money, then they released me. I didnt get arrested or go to the police station or anything. My first employer said I only write the letter and then leave the job basically I got fire, they promised me they would not report to the immigration or my sponsor. After I left the first job I continued looking for another job, a week later I got a sec job and work there until the end date of DS2019 and stay in the U.S for 1 month to travel and back to my country before my visa get expired. My sponsor of the work and travel program in my country asked me to report my arrival so I checked my status everything was fine.

Now Im applying for K1 visa and now waiting for the P3, I am so worried of the problem I had done. Will this affected to my visa? If the company who fired me report to the immigration would I cause of an overstay ?? I know I shouldnt have done this bigggg problem!! what should I do???

If you had overstayed in US during your stay here then there could be a problem ... coz that is one of the factors that will affect your paperwork ... because they will be able to trace it out because of your Name and passport number ... Just hope for the best ... and pray ... Nothing is impossible with GOD ... :star:

I do not understand. Overstay? Were you overstaying a visa in the USA when you got fired?

The circumstances of your firing mean nothing to the USCIS, or the consulate, they do not check those things and you have no criminal record. Where does the overstay happen?

To be clear, an "overstay" is when you STAY in the United States beyond the term permitted by a visa or VWP entry. NOTHING else can or does create an overstay.

If you had overstayed in US during your stay here then there could be a problem ... coz that is one of the factors that will affect your paperwork ... because they will be able to trace it out because of your Name and passport number ... well, just to be clear. God or no, if she has a long oversty, a visa is impossible. If she does not have an overstay (and I suspect she is confused about the term) this will not matter. God can concern himself with something else, nothing for him to do here.

Thank you for all your replies. I 've read on the internet that if the person come to the U.S with J1 (work &travel) and quit the first job ( not complete the program on time on the ending date) that's mean you cause of an overstay cuz the employer will report to INS, or USCIS.

And i was concerned about the problem; stole the money from the cashiering but after I get caught I got fired and move out of the employees house. I wasnt sure if the USCIS will know this problem when they check for my criminal recorded while I was in the states.

That's if you don't quit your job and leave the US before your visa expires. If your visa expires, and you are still in the US, then you overstayed your visa. If you leave the US before your visa expires, then you did not overstay.

Embezzlement (stealing money from a business you work for) is a serious crime. If your employer didn't report it to anyone, and you were neither arrested nor convicted, then it shouldn't cause any problems with your K1. However, I would be VERY afraid of that signed confession, if I were you.

You said nothing of a J1 in your original post. Dlo you think by concealing information you will get accurate answers? Noe I understand you were not confuesed at all about what an overstay is, were you?

If you are here on a J1 visa and you quit the job for which the visa was issued you must immediately return to your country. If you did not, you overstayed your visa and you DO have a problem. YES the employer WILL report this to USCIS. Normally USCIS does not check with employers but I can assure you the letter you sigend was sent to the USCIS with the cancellation of your visa (or notice that you had quit the job, thereby nullifying the visa.) You then said you got another job...illegally?

Normaly USCIS doe snot check employers, and I had no idea you were even in the USA.

I retract my previous answer. Depending on what other details you feel like providing and when, you may have a serious problem indeed.

Personally...I feel like I was tricked into giving an answer you wanted to hear. Good for you. The surprise for you is, USCIS knows the truth whether you tell us or not

Unfortunately, like all of us, Gary sometimes fails to read carefully. The opening post DOES mention the J1 and the OP indicates the employer promised NOT to report to immigration. If the employer broke their promise and/or sent the signed confession to USCIS there may be a big problem. If neither, and the OP left before they allowed stay expired, they probably got lucky.

Unfortunately, the OP won't know what the employer actually did or didn't do until it either doesn't matter or is too late.

I was suspicious that I took some money.. so they asked to write the letter as I did write the letter, they promised they wouldnt report to the immigration or take me to the police station. So if they broke their promised what would I do??

I am the HR Director, at my company, and handle the J1 program here. First of all, your employer would not report directly to USCIS. They would report the information to the U.S. Agency that sponsored your visa. This is part of the requirement of the program for the Employers. We generally will not have direct contact with immigration or the agency in the home country. Everything is done through your U.S. Sponsor. Of course some companies, such as Disney, have their own sponsorship and do everything directly with immigration. Unless you worked for a company like Disney, your employer would not have their own Sponsorship designation.. so would send everything through another organization.

If you leave your job, whether by choice or by being fired, while your DS 2019 is still valid you are not in the country illegally. IF your employer reports to your U.S. Sponsor (not your agency at home) that you have left your job it is up to the U.S. Sponsor if THEY will terminate your visa and notify Immigration they have cancelled your visa.

Some of the U.S. Sponsors have very strict rules that you cannot leave your employer, some do not. Do you remember who your sponsor was? Was it CCUSA, CCI, CIEE, Interexchange, INTRAX, WISE? This would be important. Some of these organizations will not care if you were fired, or if you went to another employer.. some will terminate your visa immediately after the original employer lets them know you are gone.

It sounds like you did not work longer than the DS 2019 allowed, did not overstay your 30 day travel part of your visa and went home before your DS and I94 expired. If you worked even one day longer than your DS allowed, or did not leave by the date on your I94 then you will have an issue with this.

If you employer did not report to your agency, then your visa was not terminated.

I cannot tell you whether or not your employer reported to your U.S. Sponsor but I can tell you that I report everything to them! I have terminated employees for theft, not reported it to the police, but DID report it to the U.S. Sponsor.

The only way for you to find this out would probably be to talk to the work and travel agency you used in your home country. THEY can then contact your U.S. Sponsor to find out if your program was in good standing or if it was terminated.

If your visa was terminated, it will be very difficult for you to get another visa here. I suggest you contact your agency and see what they can find out from your Sponsor. The sponsor doesn't need to know the details of what happened, the agency can simply ask them whether or not your are listed as having completed the program in good standing... and, again, even if they reported it to the Sponsor, some of them would not have terminated your visa. Just depends on which Sponsor you were with..

If you read up on my original post, yes I did mention of the J1 visa. I just want to know if my k1 visa will be ok. I wrote the the confession letter cuz the first employer didnt have an evidence such as a camera recorded that shown I stole their money. And they didnt call up tye corp or send me to the police station. They will not report or do anything until I sign the paper. As they give a promise to me. So that time I thought it would be ok to stay in the U.S and leave before my DS2019 was expired. Thanks for your answer again.

I am the HR Director, at my company, and handle the J1 program here. First of all, your employer would not report directly to USCIS. They would report the information to the U.S. Agency that sponsored your visa. This is part of the requirement of the program for the Employers. We generally will not have direct contact with immigration or the agency in the home country. Everything is done through your U.S. Sponsor. If you worked even one day longer than your DS allowed, or did not leave by the date on your I94 then you will have an issue with this.

If you employer did not report to your agency, then your visa was not terminated.

I cannot tell you whether or not your employer reported to your U.S. Sponsor but I can tell you that I report everything to them! I have terminated employees for theft, not reported it to the police, but DID report it to the U.S. Sponsor.

The only way for you to find this out would probably be to talk to the work and travel agency you used in your home country. THEY can then contact your U.S. Sponsor to find out if your program was in good standing or if it was terminated.

If your visa was terminated, it will be very difficult for you to get another visa here. I suggest you contact your agency and see what they can find out from your Sponsor. The sponsor doesn't need to know the details of what happened, the agency can simply ask them whether or not your are listed as having completed the program in good standing... and, again, even if they reported it to the Sponsor, some of them would not have terminated your visa. Just depends on which Sponsor you were with..

Thank you so much for your answer!! You've been very helpful. I was back to my home country before my DS2019 and I94 got expired. And my U.S sponsor was CCUSA. I was independent J1 student who found a job and contact to the U.S employer by myself. After back to my home country I did report to my agency and they didnt mention or ask me anything a month later CCUSA has sent me a certificate of work & travel prpgram. It has been 3 years now, and I am concern about my J1 visa if it was terminated or not so I called CCUSA and they said my profile status is ok. So I am so worried.. but again thank you so much!!! Wish you all the best!!

Unfortunately, like all of us, Gary sometimes fails to read carefully. The opening post DOES mention the J1 and the OP indicates the employer promised NOT to report to immigration. If the employer broke their promise and/or sent the signed confession to USCIS there may be a big problem. If neither, and the OP left before they allowed stay expired, they probably got lucky.

Unfortunately, the OP won't know what the employer actually did or didn't do until it either doesn't matter or is too late.

Thank you for all your answers. The employer dont have an evidence like camera recorded to proved that I stole their money. I was suspicious that I took some money.. so they asked to write the letter as I did write the letter, they promised they wouldnt report to the immigration or take me to the police station. So if they broke their promised what would I do??

I am the HR Director, at my company, and handle the J1 program here. First of all, your employer would not report directly to USCIS. They would report the information to the U.S. Agency that sponsored your visa. This is part of the requirement of the program for the Employers. We generally will not have direct contact with immigration or the agency in the home country. Everything is done through your U.S. Sponsor. Of course some companies, such as Disney, have their own sponsorship and do everything directly with immigration. Unless you worked for a company like Disney, your employer would not have their own Sponsorship designation.. so would send everything through another organization.

If you leave your job, whether by choice or by being fired, while your DS 2019 is still valid you are not in the country illegally. IF your employer reports to your U.S. Sponsor (not your agency at home) that you have left your job it is up to the U.S. Sponsor if THEY will terminate your visa and notify Immigration they have cancelled your visa.

Some of the U.S. Sponsors have very strict rules that you cannot leave your employer, some do not. Do you remember who your sponsor was? Was it CCUSA, CCI, CIEE, Interexchange, INTRAX, WISE? This would be important. Some of these organizations will not care if you were fired, or if you went to another employer.. some will terminate your visa immediately after the original employer lets them know you are gone.

It sounds like you did not work longer than the DS 2019 allowed, did not overstay your 30 day travel part of your visa and went home before your DS and I94 expired. CCUSA will start the process to terminate your visa the minute they are notified you have been fired for theft. If they sent you their certificate, then your employer did not notify them you were fired and they did not terminate your visa. Looks like your employer kept their promise to you.. and your visa will show you completed the program properly. As far as your K1 is concerned it looks like this will not be an issue.

Someone else mentioned that you should be worried that you signed that letter. I don't know if USCIS checks references with employers, but I believe another post said they don't. If you listed that employer on any of your K1 paperwork, I suppose it is possible they could be contacted.. but I suggest when/if you get the K1 and come here that you do not list that employer as a reference on any job applications.
