How long does adjustment of status processing?

Timeline

We are still waiting for my husband's papers before we can submit all the documents for my adjustment of status. How long do we need to wait before it can be approve if we can send the documents within next two weeks. I am not going to apply for an advance parole coz i dont want my husband to pay another fee. But, i need to go home in my home country april 2010 or atleast first week of May to get my baby and be bring her here in US.. My one yr after k1 approval will end june 2010. Is it possible for me to get the approval before april or May? Thanks

1. there is sure way of knowing exactly how many months your AOS will be approved. if you check the timelines of VJ members, there are people who got approved in 3 months, others 4 to 6, still others took longer. it depends on how complete your requirements are, luck, volume of applicants at the time you send in your application, and whoever is going to process your application. so, submit your application soonest to up your chances of it being adjudicated fast enough.

2. you don't need to pay any fees if you include your applicaiton for advance parole w/your AOS.

3. i can only hope for you that you get approved by april so make sure your application is complete and in order so you don't get any RFEs (the major reason for delays)

01-08-2009 AOS Approved! thank you Lord! no interview required!

01-16-2009 Received GC in mail

09-02-2010 Sent out application for ROC

09-08-2010 Received NOA1

09-10-2010 Received Biometrics Notice

10-06-2010 Biometrics

12-06-2010 Approved! Thank you Lord God!

12-11-2010 Received NOA2 and 10-yr GC in the mail =)

I saw that u have filed an i-131 is it free when u filed it?

if that info you saw is the most recent, then it looks like they changed the policy.

when i applied for my 1-131 there was no separate filing fee because i submitted it together with my

AOS application.

AP fee is included w/the AOS. $1,010 is inclusive of AP fee. You need not to apply for AP w/AOS but you MUST pay the fee for it.

This was as of end of July 2009, i am sure it is the same now.

Are you adjusting from a K-1 or a K-3?

If a K-3 - you should have 2 years from yer first POE entry to travel in/out of the USA.

If a K-1 - yer stuck until you have either AP or the greencard.

There's lots of variables on figuring the duration from filing to receiving, but 6 months is surely do-able - I suggest if paperwork is pristine, would have it within 2 to 4 months.
