Hello fellow members,

I am so sad and desperate that no one was able to give me any advice or tip on my other post i posted this morning intitled Urgent Help.

I think people get tired of reading my post so here i am again trying to make the story short, hoping someone can help.

We just got an RFE on the I-130 we filed for my kids(USC husband is the petitioner).

The documents USCIS asked from us is the Annullment/Death decree and foreign language documents.

Here is the scenario:

Petitioner - my usc husband

Benefeciary- my kids as his stepchildren

Entered in 2007 in K1 visa

Name of the kid's father is on the kid's Birth Certificate but was not married to the ex.

My questions are:

1.How will I get an annullment decree when in the first place i was never married to the kid's father? Cenomar proved that when I applied for my K1?

2.How will i get a death decree when i don't even know if the ex is still alive or don't evenknow his whereabouts. He was out of the picture since our 2nd child was born in 2001.?

3. USCIS wants a proof/document that the marriage between me and ex was terminated? What documents do i need to submit to USCIS to prove that we were not married?

4. Am i right that i don't need a foreign language documents since any documents iw ill submit to USCIS is in English language?

5. My kids was able to get their philippine passport by just showing the latest (august2009) CENOMAR.My Certificate of no marriage shows no previous marriages but my marriage to my husband now who is the petitioner?

6.What proof do i need to show the terminated marriage between me and ex? We are not married but his name was onthe Kid's Birth certificate as the father and there was the place and date of marriage (FAKE).

Please help me.I need your advice on what to do?thanks in advance very much.

Ok, I by no means have any experience with this, but do you have sole custody of you children and if you do, do you have legal proof?

No legal proof but my kids are with me. The father was out of the pic since 2001. They are illigitimate children bringing the father's name out of marriage. I can prove that through CENOMAR but still the father's name was on the kid's BC with fake date and place of marriage coz there was no marriage that took place.

I hate to say this but you and your Fiance may want to hire an attorney in PI to fix that. Probably 25000 Pesos or so. Good luck and I am sure it will work out.

Okay. You lied on your children's birth certificates that you were married. You provide USCIS with a CENOMAR indicating that you were never married. You then submit your children's birth certificates to USCIS. No wonder you got a RFE. You have submitted documents to USCIS that conflicts based on false information you provided on your children's birth certificates. How is USCIS suppose to determine which document is false? USCIS is probably assuming the CENOMAR is false and that is why USCIS is asking for annulment or death certificate or divorce paper. Instead of worrying about how do you get those documents which don't exist, you need to focus on correcting the children's birth certificates. Hire a Fillipino lawyer to correct the birth certificates. Send them in with an explanation as you to why you lied on the original birth certificates. Your children's cases will receive higher scrutiny because you have an instance of lying on official documents.

Thanks for ur time although in the Phils this is very common. You can use the father's name on the BC even without marriage. CENOMAR can't be falsified as it it a government document too .

You said that the place and date of marriage was fake, that will need to be cleared up. The other thing is about your children...is USCIS going to let you bring children to the US without the fathers permission? Since he's missing in action, you are probably going to have to obtain sole custody of your children. I'm with the others, it sounds like you might need a lawyer.

I hope you get this all worked out.

You provided birth certificates to USCIS with information that you knew was false. That is misrepresentation on your part and is a justifiable basis for denying the petitions. It does not matter who gave the false information on the birth certificates. What matters is that you gave USCIS documents with information you knew to be false.

You need to correct your misrepresentation. Correct the birth certificates. Resubmit them with an explanation. Hope that USCIS believes you.

I suggest getting a Filipino lawyer to correct the birth certificates and getting a US immigration lawyer to help with the correction. A screw up at this point or further misrepresentation at this could mean that your children will be denied visas. The stakes are too high for you to do-it-yourself at this point.

Why did you lie? Things like this will come back and haunt your immigration petition. If you stated that you were married, then you have to prove to USCIS that you arn't or never was. The hardest thing to do might be the best thing to do, and it is to start the process of getting the correct information to the relevant authorities in your home country so they can process new birth certificates and or new passports for your children.

Thank you all for your replies. The Birth certificate submitted to DFA and US Embassy had a supporting affidavit explaining why the Birth Certificate had the place and date of marriage. From the very start everytime the Birth Certificate is presented it always come with the affidavit of illigitimacy explaining why,what,where and when about the BC.

ANyway i appreciate your help and will try to submit the documents i have right now and see what happens from there.
