Will the USEM ask to provide something when the child's Birth Ceritificate doesn't have his bio father's name?

Is that going to be an issue?

I'm not married to my daughter's bio father, he is not listed in my daughter's b.c, its just says N/A.

Also, I am the only one who signed the Affidavit of Acknowledgement/Admission of Paternity.

Now, my USC husband wants to file I-130 for my daughter/his stepchild 6yr old in the Phils. while I'm in the AOS process.

Is it ok to file it now eventhough I'm still not approved yet?

Depending on the laws of your country, may need the biological fathers permission to get that passport, can check with your consulate for the requirements. Some of these laws twist my brain with the protection they offer to the biological father, he essentially knocks up the woman and takes off to places unknown while the mom bores that kid and supports them, for years. Not even considered in court, but we used another law to counter by suing him for seven years of back child support payments with another four added to that. That changed his tune for that permission. He didn't even want his kid, just money for that permission, later claimed the kid wasn't even his.
