Hi everyone

I am so glad I found this site as there is so much conflicting info out there and its great to have somewhere to go to where people are all in the same boat...!!

I live in Dublin, am Scottish, married my New Yorker in Sydney and now want to live with him in the US....! Seems that aint so easy... having looked and read through lots of stuff there are a couple of hiccups...! Seems as we married in Sydney I might have to go there just for my final interview - is there any way around this?

Also... and this is the bigger hiccup.... my guy lost his job last year and didnt earn much and this year is only working part time so wont meet the income levels required for the Affidavit of Support and his mom and dad are retired so they cant vouch, he has no brothers or sisters..... any ideas what happens then or is this alone enough for me not to be allowed in. I have a good job here and will find a job no problem in NYC as I have checked this out... but I understand this isnt taken into account. Does anybody know at which stage in the K3 process this is required i.e. can I get in on the K3 and before the 2 years is up, at which time finances will be much better, file it while waiting on the other forms to be processed?

I havent filed any paperwork yet as dont know what to do...!

YES there is a way around interviewing in Sydney. Go for the CR-1 visa. It is an immediate green card allowing for immediate work upon arrival in the US. It is cheaper and (often) faster than the K-3. Read the guides

Your husband must meet the income levels or have a co-sponsor (doesn't need to be family by the way). Your current job or potential job/income is not taken into consideration. The Affidavit of support is required at the NVC stage for the Cr-1 and must be met regardless of the visa you apply for.

Check around some here and you will discover the K3 is a dinosaur and obsolete at this time. There's LOTS of post backing up what I'm telling you.

There are MANY reasons. One that would affect you as you can work amost as soon as you enter the US with a CR-1. You would have to wait at about 3 months if you come on a K3.

If you can't find a co sponsor you aren't going anywhere with either visas tho.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Not reading the guides would be a critical mistake because the information in them is critical to your eventual success. Please study the guides, read discussions on the subjects of interest and carefully read the instructions for each form you fill out.

Facts are cheap...knowing how to use them is precious...

Thanks so much to all who wrote and gave advice - I really am grateful as I want to try and do this without having a lawyer do it for me. I dont want to appear lazy in any way about not reading stuff and only happened upon this site late last night and had intended to come back today and read more to familiarise myself - the questions I posted were foremost in my mind and being new to all this. Its a lot to get your head around in the beginning with the different visa names, document names, types of visa for the same thing, but read I will as on browsing this site this morning there is a lot to read...! I had only read about K3 only on my other browsings over the past week so was unaware there were other options. Thanks again everyone.

No need to apologize at all. You have to start somewhere. I always get a bit embarrassed for the U.S. when a USC here issues a put-down to anyone asking for help... Your USC mate will need to find a joint or co-sponsor, to start with.

Going ahead without a lawyer means you will be spending some time reading everything you can get your hands on, and it's all here in this website if you look.
