Got 2pages of RFE yesterday as following. I think these are not too much difficult to solve, but I just want to discuss this with VJ members for sure.

1. For the household member's income to be included in the household income, the household member's income must have been from a lawful source and earned while the household member was authorized to work in the United States. In order to procsss your application further, submit evidence that the household member on Form I-864 or I-864A was authorized to work in the Unites States.

-> My hubby just started to work, so I had sponsor with I-864A for my AOS. So for this one, I'm going to make copy of my sponsor's(which is my mother in law's) copy of biographic information page of the US passport.

2. The household member on Form I-864A failed to submit proof of current income. In order to process your application further, you need to submit evidence of the household member's current income.

-> For this, I'm going to send my sponsor(which is my other in law)'s letter of employment, and pay stubs(or other documentation of pay for the previous 6 months) as mentioned

What do you all think? Hope this is it.

Feb 6 10: Got my Greencard!

OCT 11 : Filed I-751

NOV 11 : Received I-797 Notice of Action.(It says I-751 receipt notice...1 year extended)

NOV 11 : CHECK_$590 cashed.

DEC 11 : Done Bio.

JAN 12 : Resident card date is expired.

luckykaren, did you submit two I864s? One for the USC (your spouse I assume) and one for the joint sponsor?

The copy of the US passport should be fine to establish authorization to work. Letter of employment and paystubs are fine for #2.

Thanks Greg001 and RebeccaAndPhil. It's good to hear how you guys think about this.

Yes..I've attached I-864 for my husband, and I-864A for the joint sponsor with last 3 years tax return dox for both. I think my RFE is basically asking more information about my joint sponsor's recent financial ability. I guess I need to make copy of her passport, and the proof of her current income which is letter of employment and pay stubs.

BTW, About the letter of employment...there is no certain format, right? I see what need to contain from the RFE letter(date of employment, nature of the job etc), though.

Hope I can send it back on monday...!!!

Good. Sounds like you have it under control. Yes, the letter of employment is free form. Usually employers will state that they are currently employed, date first employed and job title. If they state salary, all the better. But pay stubs establish that.

One more thing, is that 'letter of employment' suppose to be written by the boss of her work? I was about to write it down, but then suddently I've started to wonder whether it's ok to be composed by me!?

Letter of Employment is usually written and issued by the HR department of the company you work for. She should contact HR department and ask them to issue and mail her the original letter. Good luck Luckykaren!

Hey ReeRee,

That's what I thought... How about E-mail? Does it count?

From what I've read it should be typed on company letterhead and signed by hand. So I don't think e-mail would work, unless you just mean that they scanned it into the computer and attached it by e-mail. You want it to be official as possible, you don't want the IO officer to think just anyone wrote it and made up the info!

I agree with Rebecca on the letter being as official as can be. Yep, usually it is on company's letterhead with original sign. For example, when I got H-1B visa stamped on my passport several years ago in Canada, one of the documents requested was letter from employer, and I had to have my company's HR department mail the original letter to me. Hope they can send it to you in-law overnight and you will get it from her in a couple of days!!
