I am an Indian citizen and a Canadian resident. I married a US citizen in Aug 2009. We got married in India. I have been living in Canada for the last couple of years. Can we apply for K-3 visa with the Canadian consulate - I believe that the condition is that we have to apply from the place we got married i.e India. However since I am a resident of Canada and living here is it possible to do it from Canada ???

Welcome to VJ! No, you don't have to file from India

You can only file with the Canadian consulate if your USC husband is a current and legal resident of Canada. Otherwise you will file the peititon in Chicago and it will get sent to either Vermont or California for processing. You REALLY want to go for the CR-1 visa, it is less expensive than the K-3 and is far superior allowing for immediate work and green card

Welcome to VJ! No, you don't have to file from India

You can only file with the Canadian consulate if your USC husband is a current and legal resident of Canada. Otherwise you will file the peititon in Chicago and it will get sent to either Vermont or California for processing. You REALLY want to go for the CR-1 visa, it is less expensive than the K-3 and is far superior allowing for immediate work and green card

No, the virtually obsolete K3 visa must be obtained through a Consulate in the country the marriage took place. Even then, the filing is done in the USA and the petition is processed in Vermont or California. The CR1 visa interview for a Canadian resident would be in Montreal.

Follow the CR1/IR1 guide and the I-130 instructions.

Thanks for answering - We had considered CR-1 visa but the processing time is a longer than K-3 visa. My husband is a US citizen and not a Canadian resident. I am a Canadian resident / Indian citizen and we got married in India. I want to be with him asap. Before deciding on which type to visa to apply - I wanted to know if I apply for K-3 visa - can choose Canada as the consulate where I could have the interview instead of India.

K-3 actually slows the petition down. When we filed, K-3 petitions were getting approved 6-8 weeks after the CR-1s.

Plus, add the additional cost of flying to Inida for your K-3 interview since the K-3 interview takes place in the country where the marriage took place.

Anything you're reading that indicates processing time is faster for a K3 visa is at least three years out of date. The answer to your question is absolutely no. If you were married in India then the K3 visa must be interviewed for in India. Only if you marry in the USA can it be interviewed for in the beneficiary's country of residence.

Thank you for the responses everyone- much appreciated - you have been a great help

I agree I filed for both and it appeared to take twice as long as some in VJ who just filed CR1. It might have something to do with the way they can play with the days outstanding for the application so they meet their internal targets for processing. My NOA2 for both the I130 and I129 were approved on exactly the same day and I received them in the mail on the same date.
