Do I need father's concent, if he's not on stepdaughter's birth certificate??

Well, right now he's on her birth certificate, but he won't help us out and give us his concent to get her the visa. He does not provide a cent and does not care about her. I guess he has a grudge with the mother, and is trying to make it hard for us. Anyway, we're going to get the local court in bolivia to take out his last name on the birth certificate and issue us one with just the mother's last name. We're going to tell them that the father does not care about the child ect...

This way we wont need her approval to take her out of the country, and the mother will have full custody. With that new birth certificate we plan to get her a passpor ect... and i can adopt her here and give her my last name without the father being an issue. Will theyu ask for the biofather's concent, if he is not the the birth certificate and it only has her with her mother's last name? second, would i need to fill out I-130 to start her papers, and should i get a lawyer to do her paper, or is it easy. I am doing my wife's right now, but i dont want to make mistakes on my stepdaughters.

Was there a divorce decree? Does the divorce decree stipulate WHO is to provide for the care of the child? China isn't Bolivia, but in China, there is usually a 'fostering' paragraph, which spells out WHO the child lives with, WHO pays monies and to WHOM. If the father isn't mentioned in the fostering paragraph, then all assumes that he's abandoned the child.

Is there some similar wording in your divorce decree?

My wife never married the man. They only had a kid together. They seperated when my stepdaughter was 3. Since then he only saw her twice a year and never helped out my wife with a cent. So were in the process of eliminating his last name from the birth certificate and start her papers with her mother's last name only. She will have full custody and the father's parental right will be taken away. That way it is easier for me to adopt her once she arrives.
