cancelation of K1 approved petition..

me and my fiance decided to withdraw/ cancel my approved petition, how can we do that... pls. advice to those who experienced cancelling or withdrawing their petition... thank u... :help: :help: :help:

N-400:
May 9, 2017: N-400 packet was sent
May 15, 2017: NOA1 
June 05, 2017: Biometric Done
June 19, 2017: Case is in Line for an Interview
June 25, 2018: USCIS Scheduled an Interview
Aug. 02, 2018: Interview Date- APPROVED!
Aug. 09, 2018: Oath Ceremony

You really dont have to do anything.

If you dont reply to USCIS request

they will withdraw it for you.

You really dont have to do anything.

If you dont reply to USCIS request

they will withdraw it for you.

Sort of correct except the petition is in the hands of the Dept. of State now that it's approved. USCIS won't be requesting anything further. It's best to send a letter to the service center (The USC does this.) that approved the petition and a letter from the beneficiary to the Consulate indicating they will not be applying for the visa.

Facts are cheap...knowing how to use them is precious...

Hello...

we ve applied for a K1 visa long time ago as well.. it got approved.. but my finace at the time decided we would get married in Germany since he went back into the Army.. I ve sent a letter to cancel the K1 petition. I ve looked through my paperwork but never got a cancelation letter from them. I have checked my Case Number but it s not in the System anymore.. So I guess all paperwork has been cancelled....

I will drive to Frankfurt on Monday to apply for our IR-1 now.. since we re married for over 3 years now...

Applied for K1 in 2005 - Oktober NOA2 got approved.

Cancelled it cause my fiance came to Germany and we got married in Germany. Didn t need the K1 Visum anymore.

IR-1 Visa applied !

05. October 2009 Applied through Frankfurt Conulate in Person I-130 Petition payed $ 355,-

Filled out DS-230 Form while in Frankfurt handed it in and got a checklist of paperwork I have to Collect...

12. November 2009 Medical Done in Munich (super easy)

01. December 2009 Interview Date in Frankfurt (that was only a small talk)

04. December 2009 Visa (sealed Envelope) in the Mail...Wow that was fast...

15. March 2010 POE Detroit Visa activated (that was easy.. only took 1 hour)

07. April 2010 Green Card received... that was super fast...

still waiting for the Social Security NR.

thank u for the relpies here, we really appreciated, but we will refile it again... is it okay to refile k1 by same petitioner to same beneficiary?... pls. need advice.... :help: :help: :help:

Yes, it's fine if the petitioner re-files for the same beneficiary.

A waiver may be needed though if you do it within 2 years of the last one, I think I read once.

You may want to look into that.
