I am a U.S. citizen. I got married outside of United States a couple of months ago with a non U.S. Citizen. I am in the process of filing an immigration visa for my wife (intended beneficiary). I have a few questions and was wondering if any of you can help guide me through the process. Here are my questions:

1. Do I need to submit a copy of my wife’s (intended beneficiary) birth certificate from her country with I-130 form?

2. What happens if you are missing a required document when you file for I-130? Does USCIS refunds your fee and ask you to resubmit the form with ALL required documents? Or your fee is gone and you can submit a new I-130 with a new fee and required documents?

3. Can I myself (the petitioner) translate my marriage certificate into English? Or do I need to have someone else translated into English?

10-05-2010: Visa Received.

1. I sent a ceritified copy of my birth certificate in along with a copy of my passport biographic page

2. The send you a RFE -- request for more evidence -- and once you meet that request, the process continues.

3. I am guessing you could, but it'd be safer to have someone else do it, for obvious reasons.

From a close reading of I-130, it seems as if they dont require intended beneficiary's birth certificate or passport copy.

I can confirm that for you. The beneficiary spouse's birth certificate is required later at the NVC stage, not when you file the petition. When filing the I-130 for step-children, the birth certificate is required. Since you posted your questions in the K3 forum, let me assume you have K3 in mind. This is a good time to reconsider, simply following the CR1 visa path. K3 is virtually obsolete in that it no longer saves time. It just cost a lot more. This is the most frequently discussed issue in the K3 forum. Read to your heart's content.

1. You do not need to submit a copy of your wife's birth certificate with the I-130. They'll ask for that later.

2. RFE. USCIS actually deposits your check a few days after they receive the files. No need to submit a new I-130 or fee.

3. You may translate documents as long as you also provide a statement saying that you are fluent in both languages, and that the document was translated to the best of your knowledge, etc.

You could file for the CR1 and K3 simultaneously.

There is a checklist of documents that USCIS needs to process your case along with the fee. You can visit their website. You can also look on VJ's website under CR1/IR1 visa.
