need advice from people regarding k1

Hi everyone,

Im so happy i got offer a temp to hire job that pays 10 dollars and hour and will get raise to 12.00 after 90 days. I was thinking if im working now until summer of 2010 i will start filing for k1 for my fiance in summer, and hopefully by 2011 spring he can get his interview date and i have tax income for 2010. I can only show 2010 income tax and during 2008, 2009 i do not make enough but now i can probably make good money to sponsor him. what do u all think of my plan will it be good or not should i wait 3 years later to sponsor him. there wont be co sponsor cause i cant get anyone so its all up to me.

please advice anyone

You do not need to wait to apply. You just have to prove that you currently make the required amount of money, not that you have made it for three year. If you currently make the required amount, which you would at $10/hour full time for two people, there is no reason to wait unless you need to save up to pay for the application.

Good luck, and hope you can achieve your goals.

Some simple math - if you are earning $12/hourly starting in Jan 2010, and work full time at that rate for the entire year based on 40 hours/week, you will be earning $480 weekly, or $24,960 annually. I believe this is above the current poverty guidelines for a basis of two people (yourself and your fiance). If there are children involved, you will need a higher amount. Also, the amounts are adjusted annually so next year in 2010 you should verify the guidelines.

Also, note that you can file I-129F without demonstrating your income. You need to show it only at the interview stage.

What are you waiting for?

For one thing you do not need to prove income until the interview and last years income makes no difference. If you get a job today paying $10 per hour you qualify today! (provide it is full time, that would be over $20,000 per year) You do not need to wait until your next tax return. CURRENT income is what they go by.
