Anyone here tried the Fee Waiver? how does it work? what are the documents i needed to prove that we can't afford to pay for the AOS?

Just got married last Sept.4 and my I 94 will expired this Oct. 26,my husband used to work in the Wind Turbine Company but currently

they don't have work anymore for some reason guess its really because of the bad economy right now,and we didn't

expected all this to happened.Anyway i have my 2 kids with me

they were in K2 Visa. Plus another fee for me,im so sad,depressed and worried that i am gonna be out of status if we dont file for it soon.

Anyway, My husband trying really hard to find a new job,send a bunch of resume online everyday but no luck yet.

I don't think mere unemployment qualifies you for the fee waiver.

Both your husband and you don't have any savings?

USCIS does not really care that your husband is unemployed and you are not able to pay the fee. It is incumbent upon the petitioner who needs the green-card to assure that they have the financial means to apply for said benefit. Its not just having the money, but with your husband unemployed, he may not meet the standards to be your primary sponsor on the I-864. Do you have a co-sponsor? Perhaps you have some friends and family who can lend you the initial amount needed for the filing.

I'm not sure I know of anyone who has petitioned and received a waiver for the filing fees.

Yeah, sorry, but if you manage to get a waiver of your AOS fees, then I want a refund of ours :)

These costs are known way in advance of applying for K visas and should not be a surprise.

I'm sure you can find a co-sponsor though, and you should focus on that.

Applying for a fee waiver for a visa which requires proof of support is not a good idea :bonk: So you are going to submit an affidavit saying you can support your wife but you can not pay $1010 ? :wacko:

One of these days, USCIS will get smart and demand the AOS fee be paid upfront as a deposit. Then it is paid if you adjust status and if you do not go through with the marriage you can get your money back whenyou show your former fiancee departed the US within the 90 days of the I-94

I have no sympathy for someone that enters into process which has, as part of it, the payment of these fees and then saying "I can't afford it".

while he is at it, find a joint sponsor because if he doesn't have a job and a way to support you (or a joint sponsor) then you are going bye-bye anyway and you may as well save the AOS fee. I suggest your husband find a co-sponsor and borrow the money

Although the fee waiver does exist... and the forms can be found in USCIS website; I have yet to see anyone try it and succeed.

Like folks have said, unemployment is not reason for fee waiving. At all. Line up a co-sponsor, ask your friends and family for money. The process is expensive and you guys knew it form the start.

I think military probably has a decent chance of it.

No, sorry to say I don't.

It sounds to me from the original post like the OP and her husband are trying to do the right thing - they want to adjust her status as soon as possible, rather than waiting around till he is gainfully employed again. How many times have we read of people waiting realllllllllllllllllly long times to file using the excuse of finances? At least this couple realizes the importance of getting it done as soon as possible.

There are a lot of people losing work right now through no fault of their own. If the sponsor has been gainfully employed and can show a last years tax return over the necessary poverty figure the affidavit MIGHT fly. If it doesn't, but the waiver of fees is accepted, they will be RFE'd for a joint sponsor. It really cannot hurt to try.

Asylum AOS filers usually get the fee waived.

No, sorry to say I don't.

One would assume that where somebody got the AOS fee waived, there were other qualifying (humanitarian or extreme hardship?) factors that outweighed the public charge issue. The guidance doesn't say that applying for a fee waiver for public charge provision forms is impossible, it simply 'reminds' the applicant of the requirement. I think ultimately all fee waivers are at the individual discretion of USCIS aren't they?
