POSSIBLY A I485 ISSUE NOT COMPLETELY SURE

OK my wife and I need some help the local USCIS office here is a joke. My wife and daughter (technically step daughter) moved here in February and we did the K-1/K-2 visa. Our daughter was on the I-130 (i think is what its called) when we filed initially. We were under the impression that our seven year old daughter would receive her permanent resident card when my wife got hers. We went down the the Texas office and the lady told us we have to re-submit the I-485 and it will be an additional 600 dollars. When we filed the 485 we sent them a check for both of them and they sent it back and said it was too much money because she was under the age of 14 so we sent the amount they requested. We are currently at a loss and have no idea what to do. My wife has her work authorization and her permanent resident card and we have heard absolutely nothing with our daughter. Does anyone have any clue where we should look or know a phone number we can call that is staffed my people and not answering machines. We would greatly appreciate the help. I do apologize that this post is kind of rambled we are just not sure what is going on or where to turn.

In order to help yourself, you really should understand the process yourself - would likely help you immensely. A read of the K1 guide here would be a good place to start, but alas!

The K1/K2 visa process is initiated by an I 129f petition, which when approved is sent overseas to the US consulate so that your (now) wife and daughter can apply for visas to enter the US.

K visas are NOT immigrant visas, meaning they have to adjust status once in the US and apply for green cards. There is also a guide and FAQ on this website for the adjustment of status process for K1/K2 visa holders.

Also, the I 485 form instructions themselves are pretty clear (in so far as what fee you should pay for the child). Page 8 lists the rules around fees.

And just to let you know so you can ponder this, once your step daughter gets her GC and it is time to remove conditions she will not be able to ride on the I-751 for your wife as her card will more than likley be dated after the 90 day window,

Have you yet to receive the NOA for the second filing of the I-485 at 600.00?

Why is it that the only one who can stop the crying is the one who started it in the first place?
