Hi all VJ'S

I have a big problem. actually 3 weeks before i got RFE ragarding birth certificate for bot mom and dad. now after all the process done in INDIA by my cousin he found that my mom's birth certificate is available as she was born in city so Municipal office found record and they gonna issue BIRTH CERTIFICATE FOR HER.

but for dad as he was born in village and they don' found any record for dad right now.so they gonna issue NABC and also my grand ma give give affidavit. so my question is when i submit all documents with RFE USCIS will ask me question why my mom BC is available and my dad have no BC. do they gonna give problem to me? my be they denied my dad's case because of no BC. but i have NABC, 4 affidavits and election ID card. what should i do?

please help me worried about my dad's case.

Try not to worry. The USCIS knows that birh certificates are not available everywhere.

On the NVC website this is what they have posted fir this situation.

Unobtainable birth certificates

The applicant’s birth record may not be obtainable. Some reasons are listed below:

The applicant’s birth was never officially recorded.

The applicant’s birth records have been destroyed.

The appropriate government authority will not issue one.

Please obtain a certified statement from the appropriate government authority stating the reason the applicant’s birth record is not available. With the certified statement the applicant must submit secondary evidence. For example:

A baptismal certificate that contains the date and place of birth, as well as both parents names (providing the baptism took place shortly after birth)

An adoption decree for an adopted child

An affidavit from a close relative, preferably the applicant’s mother, stating the date and place of birth, both parents names, and the mother’s maiden name.

Note: An affidavit must be executed before an official authorized to take oaths or affirmations.

Don't panic. It's absolutely alright. It's good that your MOM has a birth certificate and you can submit that to USCIS, also since your Dad is having an NABC and affidavits. It would be just fine. USCIS knows that in India most of the people born before 1970 do not have their birth certificates.

Make sure for your Dad you submit his high school record, passport pages showing date of birth along with the NABC and affidavits. For your Mom, just send a copy of the Birth Certificate :thumbs:
