Hi I just received noa for I 130 petion for my wife and son respectively. Now I plan to file for I 129 , but i am confused , do I have to fill one form for both my wife and son. And also do I include both the copies of noa, while submitting the petition.

can somebody please guide me how to go about filling for I 129 petition for my and son

You should not really need to file K3 because it is not as effective today as it used to be. If you filed the I-130, wait for it to be approved. It is a better way to enter because she will already be approved to work and she will not have to adjust status when she arrives here. The k3 used to be a good route, but honestly it costs more and it takes just about the same amount of time these days.

Generally I would agree with the above poster but since only 1 petition was filed and the OP is asking about K-3 and a K-4 then I would suggest filing the I-129F for the wife and the derivative for the child. You would file the I-129F for your wife and include the NOA for the I-130

Generally I would agree with the above poster but since only 1 petition was filed and the OP is asking about K-3 and a K-4 then I would suggest filing the I-129F for the wife and the derivative for the child. You would file the I-129F for your wife and include the NOA for the I-130

Good luck.

The alternative is to file an I-130 for the child. That would be my recommendation. Why compound the extra expense by paying for two immigrants to adjust status.

BINGO! Take it from someone who paid way too much for the K3 - I did the K3.... I paid too much. Stick with the CR1 and save yourself the hassle and the money. I would not offer the advice if I did not go through it myself.

File I-130 for the child and the wife and wait for it to be approved.

Conversely, I the K3 and K4 worked perfectly for my wife and daughter back in 2006 and saved a lot of time, but that was then and this is now. Things changed, including more than doubling all the fees. I did file both I-130's at the same time though because back then the petitions raced and COULD sometimes catch up to one another. The I-130 must be filed for the child eventually. I always advise it be filed concurrently with the spouse petition and have been advising that since 2006.

Hello,

In my case we have an infant baby and we also filed for K3/K4. Also by the time my wife gets here and we apply for her GC, she will cross 2 yrs and hence wont have to pay for Removal of conditions and without Removal of Conditions the price difference wont be a whole lot. Also the Adjustment of Status for an infant child is cheaper than that for an adult and hence in our case there is not really a whole lot of difference in price for K3/K4 versus Cr1/IR1 since we wont have to pay for removal of conditions. In our case we just want to unite as quickly as possible. And with Cost not being a whole lot different we decided to go this route. We probably would be saving at most $500(together for our baby and wife). Also we have more peace of mind cuz we know we have CR1/IR1 option along with K3/k4 option as a backup. For us whatever is faster to unite is what we want and thats our priority. I will keep the group updated and let you know how it goes for us.

01/15/2010 : Embassy gets the approval notice (Awesome..Love K3...so glad we have done K3)

You're missing two key points.

1. K3 is NOT faster anymore

2. She wouldn't remove conditions from a CR1/IR1 either because she would enter as IR1 and receive a 10 year green card.
