dear friends

please can you help me with my situation. i am going to be a naturalized citizen by the end of november. i am divorced(seven years ago) and did not need her for my citizenship as i have been in the usa as a permanent resident since 1979. i am engaged to a nice girl who is also divorced but is on a conditional visa. she is officially divorced as of feb 2009. she has applied to remove the conditional status and has already gotten the extension till mid of next year. she was sent a fingerprintian schedule then was sent a letter saying that it was an error. this is my first question why did this happen?

my second is this. once if i get my citizenship can me and her get married asap. would she lose her green card? i dont mind starting the whole process of applying for her temp greencard and all of this. my quesion is actually will she be able to stay here with me or will they take away her greencard and send her back to india

please help me any advice will be appreciated. thank you

She is on a 2 year conditional greencard? She has filed to adjust status to the ten year? If so, wait until she gets her ten year.

she won't loose her greencard if you get married but you should wait because it may raise questions on her adjustment of status if she gets married before her 10 year is issued.

Just a note about the fingerprint appointment. Once you file to lift conditions, you are sent the 1 year extension and then a biometrics appointment letter. She has to complete biometrics (fingerprinting) in order for the case to proceed. If her appointment was canceled, she should figure out when it will be rescheduled.

And no... if you marry, she will not lose her permanent resident status, but I agree, if possible, wait until after she receives her 10-year.

Your marriage to her shouldn't effect her status. You should be able to marry to her it has nothing to do with immigration. You can not file for anything 'till her case finalized based on your marriage. If she gets 10 yrs green card you don't need to file for anything, if she is denied than you will need to hire a damn good attorney and fight for it.....

Starting the process again will be expensive. Is she divorced from her first husband? She can still adujust her status if she has her divorced decree and enough evidence that her first relationship was in good faith. She should go that route rather than starting all over again.

Hi guys

thank you all for taking the time to respond. she is legally divorced from her ex.

what i am worried about is after applying for the removal of conditions her fingerprinting date was cancelled and not rescheduled.

i am encouaging her to contoact via infopass to find out but she is afraid that what if before i get my citizenship they decide not to grant her and send her back. i doubt this since i know the uscis is quiet slow about things.

i have my citizenship interview on 16 nov 2009 and i am thinking at worst case i should be citizen by december. she has an extension to june

what do you guys think? should i make her take infopass and go in or should i get my citizenship and then apply again. i read above that i cannot do anything until a decision for her case is decided is that right?

hey case is not linked to your case - so HER getting an infopass appointment to reschedule biometrics will not affect HER case in any negative way, and in fact, has no impact on your case.

her case is stalled because the biometrics interview was cancelled.

If she can't reschedule the biometrics, she'll have problems later, as she wasn't able to finish up the necessary things leading to a 10 year green card.
