Travel abroad before the GC issued and without the I 512

Could somebody give me any information. I am married to a US Citizen since July 2007, and I have 2 kids from former marriage.

We applied with all the required forms at USCIS (I 130, I 485, I 325, I 864, I 765...etc) and they never issued us the temporary green card. In August 2009, my 7 y/o son was granted a permanent card and my 18 y/o daughter's permanente card was issued in September 2009.

My permanent card was DENIED, because 2 years ago I traveled abroad without a I 512 (it was when I just moved here, so I did not know I needed authorization to leave the country), and i reentered with my tourist visa that I always had before living here.

After reentering the country with my visa tourist 2 years ago, I was issued EAD, I was issued a I 512 for one year, and in September 2009, I was coming back form Brazil, and I did not know my I 512 expired 2 months ago (July 2009).

SO, i was detained for 14 hours at the immigrationa t the airport like a criminal for 14 hours, i was fingerprinted, pictured, interviewed, bla , bla, bla. And i will have a court hearing soon, I am in removal proccedings(because I left the country 2 years ago and reentered with a tourist visa). I don't have any aggravated fellony, not even a ticket, I do volunteer work, my kids are at school, the I 130 was approved, and I really acted in good faith.

Have anyone here been to a similar case, what happened? Were u successful? What may happen at the hearing? If u were succesful how long did it take to have a pemanent GC? Do I need a Lawyer?

"not knowing" does not exempt you from being subject to USCIS rules and regulations; so don't go there.

At this point, you just have to attend your court hearing, possibly with the best immigration attorney you can find, and follow ALL the instructions; never mind how ridiculous or absurd they might sound.

do you need a lawyer? YES and a good one. You are in removal proceding, you have a family in the US to think about.

Again, not knowing the law does not exempt you from following the rules.

Good luck.

Who? Lawyers? you don't have to like them, you just have to use them. And if you were talking about me, know that whatever you could possibly think about me is as relevant as it is for me whether you get your legal status sorted out or not. An attitude will not help you in these forums.
