It's true.

I am part of a UK AOS thread and over 80% of people on that thread have had their petitions transferred to California for adjudication. Mine was transferred the day of my biometrics.

08/21/2009 - AOS package sent

08/28/2009 - NOA 1 for AOS, EAD, AP

08/31/2009 - Cheque cashed

09/05/2009 - Biometrics notice received

09/23/2009 - Biometrics Appointment

09/23/2009 - I-485 Transferred to CSC

10/02/2009 - EAD Approved (card production) & AP approved!

10/11/2009 - EAD Card received

10/20/2009 - AOS approved, GC card production ordered! (53 days in total)

10/26/2009 - Green Card received - nearly 11 months to the day of our K1 NOA 1!

11/25/2009 - Started my new job!

02/26/2010 - Passed my driving test :-p

07/20/2011 - Eligible to remove conditions

2012 - Going for citizenship

09/20/2011 - Removal of conditions submitted to VSC....here we go...again!

It's been a quick and relatively painless journey thanks to tireless research, dumb luck and this community :)

DONE with USCIS for a while :)

Our AOS was approved without interview, too. One of the many attorneys with whom I spoke said that many K-1 adjustors are indeed approved without interview, likely because USCIS figures that the couple has already just been scrutinized at the consulate.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Which green card are you referring to, a conditional (2-year) green card or a permanent (10-year) green card? Are you talking about K-1ers who are adjusting status in order to get a conditional (2-year) green card? Do some K-1ers get to skip this interview? After talking to the officer, I was under the impression that all K-1ers were required to be interviewed when they adjusted status in order to get a conditional (2-year) green card.

On the other hand, I have read on VJ that many K-1ers are not interviewed when they adjust status from a conditional (2-year) green card to a permanent (10-year) green card.

Maybe it's different at the Seattle USCIS.

Many K-1ers skip the interview for a conditional (2-year) green card. This is why K-1ers are happy when their application is transferred to CSC, because it usually means no interview. It is also true that many people (K1-ers or otherwise) are not interviewed when they adjust status. Some people get both interviews, some people just one, and some neither.

It is possible that the officer meant that all K-1 applicants whose applications are transferred to Seattle are interviewed, that is probably true. But I'm sure there are K-1ers in the Seattle area whose applications never reach Seattle, the applications go from the Chicago mail room to the National Center, on to California and approval, without interview, and without visiting the local field office.

Yes, it is likely that the Seattle officer was talking about applicants whose applications were transferred to the Seattle office. However, I have not yet noticed any couples on VJ from the Seattle area who were not interviewed for their conditional green card. I'm going to start keeping an eye out for this.

The OP knows what to do, he's just unsure of wanting to move ahead. Waiting will only cause him more grief, and so will hoping for any revenge. Maybe it's his family that is keeping him from acting quickly.

No, man. What's keeping me from acting so quickly is that I love her...in some twisted but real way... and I'm afraid I'll do something I'll regret later...

I don't know what to say. I can't read this back and forth legal talk any more. it's just too much... :(

all i wanted was for us to be happy together... I lived in her home country for a whole year, waiting with her for the k1 visa to get approved... always worried that it might not. then we got it... and everything was perfect.

it was just what I wanted... it was great. we could finally be together in america.

and then... everything took a dump.

and now... its nothing I wanted.

Some part of me wants to be with her still, and find that love again, and forgive her.

Another part of me wants to just forget about her, move on, don't care if she get's her green card or not and live my own independent life, and if a new love comes alone then great...

I dunno what to do.

Nate...I'm sorry that you are going through all of this because you don't deserve it. But, it is really happening to you...and you need to listen to the part of you that wants to cut her loose and move on with your life. It is a difficult thing to do, but it will get easier day by day.

She is the worst kind of person...someone who used you...someone who used your heart. She is not honest and she can't be trusted. Someday soon you will realize that she is not worthy of your love.

Divorce her and don't look back. She won't escape her Karma.

I've gone through the same thing as you, not wanting to let go. I've come a loooooong way.

I have filed for an annulment based on fraud and am currently waiting for him to respond. Keeping my fingers crossed he doesn't. I did need to get an attorney because regardless if he responds or doesn't I still have to go infront of a judge and prove my case of fraud. As my attorney put it, "as long as you have witnesses that he personally talked to and told them he was using you for his papers, that is all the proof you need." They just need to be willing to come into court and testify on your behalf. If he doesn't respond or show up, I still have to take someone to testify. If he does respond and show up in court I have to take many witnesses to prove my case.

Of note, when I filed my papers, I marked annulment of marriage based on fraud and also marked that in the case of annulment not being granted, requesting dissolution of marriage. This way I don't have to go back through the whole process if for some reason the judge has a soft spot for the ex and doesn't grant me annulment based on fraud.
